Matthew Tosser blames recession rather than fraud allegations for 10% job losses at Hugh James

WalesOnline - News - Wales News - Workers at top Welsh law firm face losing jobs: "Managing partner Matthew Tossell sent a message to staff earlier this week claiming the impact of the recession meant that “like most UK businesses, Hugh James is having to take steps to cut costs in order to ensure the long-term future of the firm”.
Mr Tossell said: “Given the prevailing economic climate, it is clear that we need to reorganise certain areas of our business in response to market conditions.
“We believe that we can only achieve that through a reduction in staff numbers which we anticipate to be in the region of 10%."

MORE gloom for leading law firm Hugh James as a formal consultation on job cuts has been announced

WalesOnline - News - South Wales Valleys - Merthyr - Job losses at town’s leading law firm: "MORE gloom for leading law firm Hugh James as a formal consultation on job cuts has been announced.
Employees at the Merthyr Tydfil branch had already been left reeling after being told their departments were to be gradually moved to Cardiff, with some fearing their inability to move would force them to quit.
But the 18-year-old company, which employs 600 staff across Wales, has admitted the financial crisis has forced their hand and redundancies are being strongly considered."

With a predicted one in ten staff to be axed, according to managing partner Matthew Tossell, it leaves scores of workers left worrying for their jobs.

In a statement, the firm said: “Hugh James can confirm that its staff have been informed of the need to review staffing levels in response to the current economic climate and the difficulties being faced by a number of its clients.”

Mr Tossell sent a message to staff earlier this week claiming the impact on the recession meant that “like most UK businesses, Hugh James is having to take steps to cut costs in order to ensure the long-term future of the firm.”

Mr Tossell said: “Given the prevailing economic climate, it is clear that we need to reorganise certain areas of our business in response to market conditions. We believe that we can only achieve that through a reduction in staff numbers which we anticipate to be in the region of 10%, although we will do all we can to keep job losses to a minimum.”

Question 90 (Mr Austin Mitchell): Indications of fraud in the case of Mrs Ann Elizabeth Evans

http://www.publications.parliament.uk/pa/cm200708/cmselect/cmpubacc/350/7102210.htm

The Committee requested a note explaining the case of Mrs Evans. The Department has reviewed the history of the issues raised by Mrs Evans.

Complaints made by Mrs Evans"

In 2001 Mrs Evans made multiple complaints to the Law Society against the solicitors (Hugh James in Merther Tydfil) who handled her compensation claim for respiratory disease in respect of her late father William John Thomas. The various documents attached to Mrs Evans' letter outline the complaints made. In particular Mrs Evans alleged that her solicitors had:

— delayed in "registering" Mrs Thomas' claim until May 1998;

— failed to make a timely application for an interim payment;

— failed to respond to individual letters and telephone calls;

— delayed in providing costs and client care information;

— provided advice and information that was confusing;

— failed to apply appropriate supervision to junior staff; and

— altered the claims form (claim questionnaire) without her knowledge or consent, in a way that artificially inflated the value of the claim.
Appeal to Law Society

Mrs Evans appealed the Law Society's original decision and this was reviewed by the Adjudication Panel and their ruling was handed down on 22 June 2005. The upshot being that Mrs Evans' appeal was upheld and two partners at Hugh James each received a severe personal reprimand from the Law Society in respect of their failure to properly supervise their staff. Additionally, it is clear from the Law Society's findings that the only reason a finding of misconduct had not been made is that (by reason of the poor supervision) it was not possible to identify the individual at Hugh James guilty of the misconduct. The Adjudication Panel raised Mrs Evans' compensation from £1,250-£5,000. Hugh James challenged the decision by way of Judicial Review.

Throughout the dispute Mrs Evans kept the Department (through its external lawyers Nabarro) appraised of her case and she also sent copies of the Law Society's report and findings to Sir Michael Turner, the Judge then overseeing the COPD scheme.

Department's consideration of the position

The Department carefully considered the issues raised, especially in terms of potential impact on the wider administration of the schemes. The main issue being the Law Society's finding that Hugh James Solicitors had altered Mrs Evans' claim questionnaire form. Furthermore, the nature of the supervisory failures by Hugh James Solicitors ("...monitoring individual files by computer screen and monitoring DTI statistics...") raised concern that these failures were not limited to Mrs Evans' case alone. It was also apparent that the two partners were two out of five members of the Co-ordinating Group (CG) of solicitors representing the claimants under the scheme.

A range of actions were undertaken:

— Nabarro (the Department's legal advisers) held a full meeting with Mrs Evans on 29 June 2004;

— a request was put to Capita's Security Investigation Department (SID) to filter out similar type cases intimated via Hugh James Solicitors for analysis;

— a letter dated 7 September 2005 was sent to the Senior Partner at Hugh James Solicitors requesting a full written explanation and detailing the organisational failures which have led to the findings against them, together with details of what changes have been made, in light of those findings; and

— a copy of the letter to Hugh James Solicitors was copied to a member of the Claimant's Group, suggesting that the CG should raise the issue at the next Review Hearing and address the issue in its written report to the Court.
Current position

As far as the Department is aware the case remains subject to ongoing review by the Solicitors Regulation Authority (SRA). In these circumstances the Department is not currently in a position to take further action

High Court ruled that several miners law firms would have to repay the Government an estimated £100m

The Lawyer (9 April), 30 firms shared a pot of almost £800m for litigation costs.

Just weeks later, the High Court ruled that several miners law firms would have to repay the Government an estimated £100m after being overpaid in relation to the respiratory disease compensation scheme.

http://www.thelawyer.com/miners-compensation-gifts-firms-another-%C2%A3174m/133150.article

The leading law firms involved in handling the British Coal compensation claims pulled in £174.3m in the last year, despite the Solicitors Regulation Authority (SRA) continuing its investigations into several firms for misconduct.

Doncaster-based three-partner personal injury boutique Beresfords topped the breadwinners' list after bringing in £43.3m, according to figures derived from a written answer by Labour peer Lord Bach.

Thompsons Solicitors were second on £27.1m, followed by Cardiff-based Hugh James on £24m.

.One SRA insider said law firms reaping such huge sums of money on the back of miners suffering conditions such as respiratory disease and vibration white finger projected the wrong image of the legal profession.

"Some politicians are calling the saga a feeding frenzy for lawyers, and with figures like these coming out of the taxpayer's pocket it's hard to argue," said the source.

The SRA, however, said the 53 investigations into how the law firms have conducted themselves through the British Coal scheme will continue, despite many firms having to pay millions back to the Government after being overpaid.

Last year, as revealed in The Lawyer (9 April), 30 firms shared a pot of almost £800m for litigation costs.

Just weeks later, the High Court ruled that several miners law firms would have to repay the Government an estimated £100m after being overpaid in relation to the respiratory disease compensation scheme.

The Lawyer can now reveal that, according to the Government, the final figure that "several hundred firms" have to pay back is £80.6m. Beresfords was one of the firms indebted to the Government. According to the latest accounts the firm had to return £10.9m, which the Department for Business, Enterprise and Regulatory Reform (BERR) said had been paid.

In addition, there were 15 other firms that owed more than £100,000 to BERR - Avalon Solicitors among them. The Warrington-based firm's senior partner Andrew Nulty was last year ranked the second highest-earning lawyer in the UK, taking home £13m. He was only pipped to the post by Beresfords name partner Jim Beresford on £16.8m.

The BERR said around £6.3m remained outstanding by the time the debts were due to be settled on 30 May. "Agreements are already in place for repayment by some firms with outstanding debts by the end of the year," said a BERR spokesman, adding that after 12 June these payments would be subject to an 8 per cent debt judgement interest rate.

The spokesman added: "Discussions are also in hand with other firms where they have asked for some more time to settle their debt and the department is reviewing these requests on a case-by-case basis."

Beresfords declined to comment.

This Doncaster-based boutique last year could boast it had the UK's highest-paid lawyer, with senior partner Jim Beresford taking home £16.8m. But he may have lost this title.

According to the firm's latest accounts, Beresford's entitlement dropped by more than a third to £10.8m. His daughter Esta and Doug Smith, the other two partners in the firm, saw their average take-home fall from £1.8m to £1.3m.

The firm witnessed a revenue increase of 20 per cent on the previous year to £41m, but profit dropped from £20.4m to £13.5m. The accounts stated: "[This is] mainly due to the reduction of OROS [optional risk offer schemes] fees relating to the British Coal costs hearing which has recently been settled." In English that translates to profit is down because of the £10.9m Beresfords had to pay back to the Government after a High Court case

£50,714,270.57 £18,893,532.91 £31,820,737.66

Avalon, ranked 7 in the table above, is contesting the Department's entitlement to recoup any money. As they are not members of the Claimant Group (CG), Avalon argues that the Court Order[25] is not binding on them. A Court Hearing to resolve this issue has been scheduled for w/c 26 November 2007. In the meantime the Department is beginning to recover the debt via a set-off arrangement of fees for claims due to the firm.

I am uneducated when it comes to other SSRi's. I cannot be expected to have knowledge of all SSRi's,

(Bob Fiddaman said)

I have researched Seroxat and no other SSRi. If you or any other person want to ask about any other SSRi then create a blog like I did instead of creating a blog about someone you are obsessed with. Maybe then, you may get your questions about other SSRi's answered.

I have been granted a meeting with the MHRA. I will be discussing the Seroxat withdrawal issue because that is what I write about. If you want to discuss anything with them why don't you ask for a meeting?

It is not my job to discuss SSRi's that I know nothing about.
I am uneducated when it comes to other SSRi's. I cannot be expected to have knowledge of all SSRi's, it's taken me 4 years to educate myself on Paroxetine.

Like, I said. If you or any other has a gripe with any other SSRi then create awareness, ask for meetings. If YOU have a problem with a particular SSRi then YOU must start banging the drum about it and not expect other people to do it for you.

But he has warned GPs to be more alert to possible withdrawal symptoms

Dozens of Irish people who took the anti-depressant drug Seroxat have contacted a Dublin solicitor with a view to launching legal proceedings against pharmaceutical giant GlaxoSmithKline.

Solicitor Raymond Bradley of Dublin-based Malcolmson Law, which represented haemophiliacs at the Lindsay Tribunal, said his office had been contacted by Seroxat users who claimed to have experienced adverse effects.

The calls have come after a recent report claimed that users of the drugs had an increased rate of suicide attempts, but that GlaxoSmithKline had suppressed clinical trial results"

So what is all the fuss about Mr Fiddy - are you trying to defraud GSK like you did Landrover / Ford?

there must be another reason? YES Fiddaman's inflated ego and arrogance got the better of him

I was hoping he wouldn't let his inflated ego and arrogance get the better of him ……… but I guess that was one hope too many ……… definitely beyond realistic behest to the universe - because his response was

"I think it's a good thing to branch out and create awareness about the dangers of antidepressants and this will not need any consideration on my part."

"as far as helping other people get off the (SSRI) drugs go - he (FIDDAMAN) has no idea,"

Yesterday - I was bemused and dazed to see that Mr Fiddy posted with such bristling relish his invitation to write on the newly set up My Face Networking http://www.myfacenetworking.com/ who's owners would apparently be

"delighted if you could participate by writing a regular feature that we hope to dedicated to people who are struggling to taper off antidepressants."

Firstly, I was bemused as to where they got the notion Mr Fiddy should / could write about SSRI withdrawal – if they had read his "site with great interest" as they say they have …… they would know that as far as helping other people get off the drugs go - he has no idea,

more from UKsurvivors on - " Seroxat documentaries win Awards "

uksurvivors : Message: Re: Seroxat documentaries win Awards: "Silvis thank you for supporting what I said about Mental Health Media (MHM) ……..

I find it quite baffling that someone who has been exceedingly active and obtusely vocal on the psych drug boards since 2002 -- as Mr Fiddy (Bob Fiddaman) has –- is still so sublimely uninformed of actual facts, knowledge of the whole SSRI / SNRI drug class and associated MH issues ….."

I seems that a lot depends on where you arrived on the forums, who took you under their wing, what their agenda was ………. and why you first came, whether you have the strength of your own convictions and the ability to keep perspective and objective.

Unfortunately the single issue campaigners are so focused on their own agenda they don't bother to look at the whole – even when their issue is a small part of a very much larger problem – and by giving no thought to what is actually happening – they make other small parts of the whole a great deal worse – as the stats clearly indicate.

"I think it's a good thing to branch out and create awareness about the dangers of antidepressants and this will not need any consideration on my part."

A little late in the day (over seven years) for Mr Fiddy to apparently develop consideration for anyone taking ADs `other' than Seroxat - but I was dazed by the speed of his actions - good to his word he has already set up a blog that despite the sentiments of his statement is called … d-dah

Seroxat Side Effects http://sideeffectsseroxat.blogspot.com/ with My Face Networking

Um! Surely - given the ethos to "branch out and create awareness" maybe `SSRI Side Effects' or "Antidepressant Side Effects" would have been a tad more conducive.

I wonder if the requesters will be so "delighted" when they realize he seems to have chosen to ignore the point of their letter -- although I honestly doubt they'll care or notice.

It will start with a list of Seroxat Side Effects and just end up another diatribe of what Mr Fiddy went through withdrawing, along with the obligatory evils of Soroxat and GSK ….. and I expect probably be somewhere else to avoid because of the rehashed content and tracking cookies he'll imbed!!!

Oh! BTW as MyFaceNetworking's `invitation' seems to have gone to Mr Fiddy's head you might want to avoid his other new Seroxat centred blogs for the same reasons …………

I'm not belittleing what Mr Fiddy has been through with respect the drugs and the really sad thing is Mr Fiddy doesn't seem to realise he's being exploited and used……. again.

Service for 'forgotten paupers'
The hospital was opened in 1906 and closed five years ago
Thousands of former psychiatric patients could be buried in unmarked graves across Scotland, according to a Livingston MP.
Jim Devine called for an audit after it emerged that 831 patients of Bangour Village Hospital, West Lothian had been interred in cemeteries with no markers.
The MP said he would be writing to the health minister to request checks be made at other former hospital sites.
A service of dedication will be held at Ecclesmachan Church on Friday"

Catherine Ferguson, a local woman who discovered the graves after carrying out research, said: "It's important to have a memorial service for people who were forgotten in life and whose bodies were unclaimed in death."

Local historian Sybil Cavanagh said the hospital catered for people with mental health problems who were dependent on the state.

The local council has now placed plaques in the three cemeteries
"It was an asylum built in the early 1900s for Edinburgh's lunatic paupers, as they were then known.

"The Edinburgh Lunacy Board, which ran Bangour, also had responsibility for burying these patients in a very basic burial, with just the hospital chaplain and a hospital staff member there to see the patient into the grave.

"In most cases the board buried the patient because there was no-one to claim the body, the fact that they were unmarked would be purely a matter of finance as it was fairly costly to have a gravestone."

Mr Devine, a Labour MP, welcomed the commemoration of the former patients but said wider questions still needed to be answered.

"I'm writing to the health secretary, Nicola Sturgeon, asking her to find out how many former psychiatric patients are buried in unmarked graves in Scotland.

"If we've had nearly 1,000 people from Bangour alone, given that we've had 40 major psychiatric hospitals in Scotland, we could be talking about tens of thousands of people."

The bodies are buried at Ecclesmachan, Loaninghill and Uphall Old Cemetery. West Lothian Council have now placed plaques at the three locations.

This is what this mind-poisoning deadly rubbish does and

Four types of medication prescribed to Wood were also found, though Jenkins said until the final toxicology report is completed it can not be determined whether any of them had been ingested prior to, or during, the events of last week.

The medications recovered include paroxetine, a drug used to treat depression, obsessive compulsive disorder and panic disorders; buspirone and alprazolam, both anxiety drugs; and Cymbalta, an antidepressant also used to treat anxiety.

Paroxetine is commonly known under the trade name Paxil; buspirone as Buspar; and alprazolam as Xanax.

reach people and cause real change or is it useful for a kind of pc way
of getting more funding and doing so inside incestuous circles ..

The MH charities and hangers on and in, are quite evil and corporate in
their ways - very dodgy with impression-skills and public relation
tricks ..

Mental Health Media are SUPERUSERS – just like Mark Harvey - Panorama and the SeroxatUSERGroups

LOL lol Fiddy –
Do you not realise that Mental Health Media are to mental health patients – exactly what Mark Harvey - Panorama and the SeroxatUserGroups owners are to people who have been caught up in the Seroxat furore and duped into the GSK litigation –

they’re all “Super Users” - just out to gain from others misfortunes by exploiting them ………..

Not the most thoughtful action coming on a mental health board and proffering their name like some sort of worthy accolade to excellence –

“Super Users” awarding “Super Users” – is a bit like one “Seroxat Campaigner” congratulating and bolstering another “Seroxat Campaigner” ……
hollow victories and irrelevant platitudes by any account - whilst Pharma carry on regardless and other SSRI / SNRI prescriptions numbers spiral ever upwards as Seroxats decrease and dwindle to a dribble –

The “True Legacy” of Panorama, the Lawyers and Seroxat Campaigners to Non Seroxat litigants and UK population in general is quite evident in government statistics.

Dear Group,

Firstly, forgive me for the intrusion and for being of topic.

Research has led me to alt.graphics.photoshop and various other newsgroups
with regard to someone who used to post in here [and possibly still does]

Reading through the Usenet archives it seems this individual upset quite a
few people in here many years ago.

Obviously I don't want to create a large thread on this topic and would
prefer that any correspondence be mailed to me direct.

Do you, or have you had any 'flame wars' or correspondence with any of the

These identities all go back to the same person. Originally from Strangford

Can you ever remember getting into any sort of disagreement with any of the

If you have any information please contact me on my email address.

Thanks in advance

It's a rainy day and you've just planted some petunias in the garden. Unknowingly you've created an earthly version of snail heaven. Snail hormones begin circulating and hearts beating.

Strangely, the hormone that activates the snail heart is serotonin, the psychotropic chemical so beloved by antidepressant manufacturers for its ability to quieten the human brain.
The snail heart copes well with the onslaught of serotonin. La Trobe pharmacologist Michelle Gibson has indentified two serotonin receptors in the snail heart and is investigating changes in intracellular chemicals.
These studies may have implications for humans as the snail heart could be used as a model to study, for example, the cardiovascular side effects of selective serotonin reuptake inhibitors, drugs like the antidepressant Prozac and some diet pills.
Dr Gibson says that snail heart tissue is much easier to obtain than human tissue and works as a good model. Snails hearts have a single auricle receiving blood from the lung and a single ventricle that pumps blood to the rest of the body, much like it does in humans.
Her results were presented to the Australian Health and Medical Research Congress in Brisbane."

Fiddy said "getting better because I was tapering" & "I was happy in myself that I was 'getting there'."

The Risks Outweigh the Benefits: "I moved out of the marital home, leaving my 3 sons behind me. Again, I felt no emotion. I moved across the city to live with my sister. She educated herself on withdrawal problems and made things really comfortable for me. I owe her a great debt. I lived with her and her two children for about 5 months before being given keys to a one bedroom council flat just around the corner from her. In fact, part of the reason I was able to live so close to her was because the Housing Department had agreed that I needed someone close by to help me through withdrawal. I guess I have GSK to thank for my one bedroom council flat.

I was elated when I got my own place, it meant I could see my children again, more importantly show them how their dad was getting better because I was tapering - and had been during my time spent living with my sister.

The zaps were still with me as was the irregular sleep patterns but I was happy in myself that I was 'getting there'."

I PHONED A FRIEND who lived nearby - it was one of the rare occasions where reality had dawned !!

The Risks Outweigh the Benefits: "After I swallowed the tablets I phoned a friend who lived nearby - it was one of the rare occasions where reality had dawned and I realised that I had made a huge mistake. My friend phoned an ambulance and I was admitted to hospital and kept in for observation overnight."

Numb, on a different planet, night sweats, confusion, lack of empathy and blurred vision - happened when I was not withdrawing

The Risks Outweigh the Benefits: "I was numb and at times I thought I was on a different planet with back-to-front time zones. Night sweats, confusion, lack of empathy and blurred or delayed vision became common. I felt like a prisoner in my own home. People complain about Seroxat withdrawal... all of the above happened when I was not withdrawing.Things came to a head and I tried to take my own life by swallowing 20 or so Seroxat tablets. My then wife was on holiday with a friend. I just wanted out, I didn't care for anything, I had put weight on, my marriage was a sham, my children would take a wide berth when walking past me and would rarely talk with me for fear of me 'snapping'. I just did not care about anything, a complete lack of empathy for everyone and everything. I wanted the old me back, wanted my children to have a dad again. I couldn't see how that could happen. Here I was with a lump sum of money yet I was considerably withdrawn from reality. My world seemed my own and nobody else's. I didn't want anyone else to come into my world because I knew they wouldn't like it."

Typical case insurance @ £3000+ per year

Medical Claims Forum: "We have also had many cases where Insurance is offered where regularly the Claimant is being asked to meet premiums in excess of £3,000.00. It is not necessarily a question of those “in real need” but even “little England” those with a moderate amount of savings or average income.

Let me give you by way of an example a recent case in which an elderly lady who is very disabled as a result of negligent surgery (for which we have a very positive report from a leading specialist supported by positive advice from senior specialist counsel). That client was asked to pay a premium of around £3,500.00 for only “12 months” cover and for an adverse costs order of £25,000.00. If we cannot get the case completed within 12 months (and it has to be said the Defendants and indeed the court are not seeking to help us with speed) then she will be required to pay a premium of almost the same again for the next 12 months. That was the only premium that we could obtain."

I'm sure you are aware that the press has really got hold of this story about the lawsuit in NY. Do you know of any people in your group who were under 18 when they were prescribed Seroxat (or parents) who might be willing to speak to the media today? We can provide the usual PR support.

Hi Jonathan, sorry for the delay getting back to you, yes I was made aware yesterday that there would likely be media frenzy over the lawsuit in NY Vs GSK & Paxil and had already written a letter to Mr Iain Luke MP for Dundee East regarding the matter prior to the Guardian newspaper etc., getting wind of it today of which he will receive by Royal Mail First Class Recorded delivery tomorrow. We do have several adolescents within the group under the age of 18, including parents of children affected by the dangerous antidepressant Seroxat. I will inform the group of your wish for anyone involved to partake in speaking to the media regarding the matter through Hugh James PR. Would you be interested in sufferers outside our group as I have several contacts within the United States.

Baby, do you understand me now
Sometimes I feel a little mad
But don't you know that no one alive
Can always be an angel
When things go wrong I seem to be bad
But I'm just a soul whose intentions are good
Oh Lord, please don't let me be misunderstood
Baby, sometimes I'm so carefree
With a joy that's hard to hide
And sometimes it seems that all I have do is worry
Then you're bound to see my other side
But I'm just a soul whose intentions are good
Oh Lord, please don't let me be misunderstood
If I seem edgy I want you to know
That I never mean to take it out on you
Life has it's problems and I get my share
And that's one thing I never meant to do
Because I love you
Oh, Oh baby don't you know I'm human
Have thoughts like any other one
Sometimes I find myself long regretting
Some foolish thing some little simple thing I've done
But I'm just a soul whose intentions are good
Oh Lord, please don't let me be misunderstood
Yes, I'm just a soul whose intentions are good
Oh Lord, please don't let me be misunderstood
