This seminar will describe the work of the Seroxat and SSRI User Group in the UK. GlaxoSmithKline, a multinational pharmaceutical corporation, manufactures and markets the drug Paroxetine - a Selective Serotonin Reuptake Inhibitor (SSRI) used in the treatment of, inter alia, ‘depression’ and ‘anxiety disorders’. The drug is marketed under the brand names ‘Seroxat’ in the UK and ‘Paxil’ in Australia and the USA. The Seroxat and SSRI User Group believe there is now considerable evidence to suggest that Paroxetine is clinically ineffective and potentially toxic for adults as well as children, yet Paroxetine remains one of the world’s best selling prescription drugs. I will describe how the UK political system, the medical profession, and the university sector have colluded with the pharmaceutical industry to promote GSK shareholder profits at the expense of public health

Paul, well done for speaking up at the board of trustees meeting. Remarkable how radical sympathisers are out there in the most unexpected places. Your posting made me think of SUG.

Seroxat User Group (SUG) (http://www.seroxatusergroup.org.uk/) are a small, largely underfunded (surviving on just a couple of hundred pounds a year from private donations) organisation that supports people who have experienced ill effects from taking Seroxat (an SSRI anti-depressant) and seeks to ensure people are provided with adequate information on all the possible effects of taking the drug before they receive their perscription. As well as offering support to Seroxat users/survivors, the group is simultaneously seeking to take legal action against the drug manufacturer (GlaxoSmithKline). The legal action concerns GlaxoSmithKline (GSK)'s witholding of clinical data that showed the company knew about Seroxat's toxic effects (including increased incidence of violent thoughts and behaviour towards self and others) and lack of clinical efficacy (performs no better than placebo in treating 'psychiatric conditions'). Moreoever, SUG are working to hold the government to account for not adequately protecting the public against GSK.

Some of you who are based in the UK may remember a couple of BBC Panorama programmes on GSK and Serxoat. For those who haven't seen the programmes, you can view a 6min YouTube synopsis at http://www.youtube.com/watch?v=WA7NrWdlMSE or access the whole documentary from a link on the SUG website [http://www.seroxatusergroup.org.uk/].

Thus, SUG are trying to take legal action against GSK both through taking out private citizen class action suits (which is difficult following the changes to Legal Aid in the UK that mean pro bono legal support is now much harder to obtain for those wanting to litigate against multi-national corporations) and through the government's Medicine and Health Care Products Regulatory Agency [MHRA] (which is difficult because MHRA have ties with the Department of Trade and Industry (now known as the Dept. for Business Enterprise and Regulatory Reform) whose remit is to ensure the UK is a good place for companies like GSK to do business. Indeed, the MHRA legal investigation into GSK (MHRA were in effect forced into conducting a legal investigation following successful legal action in the USofA taken against GSK over the withholding of clinical data on Seroxat [aka Paxil] ) has now been running for over four years. MHRA have told SUG that they will not publically disclose the nature of the investigation nor publically disclose when (if!) the investigation might reach a conclusion.

Considering the massively powerful corporation they are confronting (GSK), it is remarkable how SUG have survived for as long as they have. Indeed, perhaps it is because SUG are taking on such a powerful, highly litigious multi-national pharmaceutical corporation that it is virtually impossible for them to get funding or government support.

Paul, I wonder if the funding you mention could be used to help such hard to fund organisations that are seeking social justice through holding corporations and government to account for state-corporate created and supported crime and social harm (ie., such groups are hard to fund because they are confronting head-on very powerful organisations whose tentacles of patronage and influence run long and deep into our economic, political and judicial systems). I am not pleading a special case for the Seroxat User Group (actually, that's a lie, I actually am because because I really believe in this group and desparately want to find support for them) but I thought it might be useful for you when you are writing up your paper - i.e., gives a concrete example of a group that is radical by virtue of being beligerent in pursuing it's agenda for social justice in the face of being crushed by an extremely powerful multinational corporation (e.g., GSK's pre-tax profits for the second quarter of 2007 was 1.89 billion pounds). Moreover, it is a group that has been left largely unprotected by governmental institutions (that are supposed to provide its citizens with statutory protection against harm) perhaps because of the degree to which this group's call for social justice threatens the economic and political status quo (challenging government institutions that pursue an agenda concerned with expanding UK economic growth and interests at the expense of local and global social justice). In this regard, though those who organise SUG do not identify themselves as radicals, SUG's activities and aims are among the most radical and socially progressive I have come across in my short life as a critical and community psychologist.

The lawyer for a man accused of a 2010 bank robbery plans to raise the defense at trial that Feliz Vega Jr.’s medication inhibited his ability to distinguish right from wrong.

In a status conference Monday that replaced the scheduled trial, Peter Johnson said he would be calling expert witnesses to prove Vega was mentally incompetent at the time of the robbery.

“What was working on him was negating any ability to form criminal intent,” said Johnson, referring to Vega’s anti-depressant drug Paxil.

But Assistant District Attorney Hank Syms waved away any claims of “involuntary intoxication,” telling Superior Court Sheryl Jolly he would object to any witness testimony that did not directly reflect on Vega’s state of mind when he entered the Bank of America at 1740 Gordon Highway on July 30, 2010.

He warned that he would be recommending the maximum sentence of four consecutive life sentences plus five years if Vega was convicted at trial in early February. Vega is charged with four counts of armed robbery and fleeing and attempting to elude.

Syms said that about a third of clients that make guilty pleas in court say they are on some form of medication. But Syms said this is the first time he’s heard this medication defense because most attorneys know better than to try it.

“What we have with this charade about ‘Paxil made him do it’ is the opposite of taking responsibility,” Syms said.

Syms said that Vega entered through the rear door of the bank about 5 p.m. wearing a ball cap, ski mask and batting gloves. He pointed a paintball gun at four tellers and told them to place cash in a multi-colored happy birthday bag, Syms said.

Vega escaped with almost $12,000 in cash, but one of the tellers had placed a satellite tracking device in the bag that led deputies to his location near Central Avenue. Vega led deputies on a high-speed chase for several blocks before crashing into a fence and a parked car on Starnes Street, Syms said.

Numb is a frightening journey into my own very personal attempt to break free from my physical and psychological dependence on the popular antidepressant Paxil.

When I realized that I was approaching my 10th anniversary of taking the drug, I knew it was time for me to reassess what it meant to be me. I was struggling to accept the way my emotions had become so blunted over the years. I wasn’t sure if it was me, or if it was me on the drug – but I needed to find out.

In the beginning my plan was simple – stop taking it and see what happens. Turned out that was a really bad idea! After a quick search on the Internet, I realized it wasn’t going to be that easy – and that, in some cases, withdrawal from these drugs can be very difficult and even dangerous. My first reaction was anger – I felt betrayed - no one told me ten years ago that I would have a problem stopping the drug or that there were risks involved. I felt trapped.

I went into pre-production right away, calling experts and doctors, setting up interviews and scheduling travel. Within a month, I was standing in my bathroom, cutting my first pill in half. I had no idea where I was headed but I knew I needed to go there.

I always knew that someday I would make a feature film – I just had no idea that I would end up being the subject! I’ll have to admit, in the beginning, making Numb was extremely exciting. I was embarking on a journey that I had no idea how it would turn out. You can see how enthusiastic I am as I start cutting my dose. But as the days go by, you can really see the impact of the withdrawal - and how fast my mental and physical state deteriorates. As I was filming, I kept thinking that there was no way that I was going to let other people see me in this condition – but luckily, I kept the cameras rolling.

Post-production was a long, difficult process. I wasn’t too excited about reliving the experience again and again in the edit suite – but I also knew that I couldn’t keep what I learned and experienced to myself. This was a story I had to tell – as personal and painful as it is – I had no other choice.

In the end, Numb took a great toll on me – it challenged my relationships, depleted my savings and threatened me physically and mentally – but I couldn’t be more proud of the work. As tough as the subject matter it is – and as difficult as it is to talk about – that’s exactly what we all need to do.

Some alarming stories about side effects from wonder drug Prozac and related

anti-depressant drugs are now emerging

Drug dependency nearly ended Ramo Kabbani's life. But the drug she battled

was handed out by a qualified GP, is being taken by 40 million other people

and is still lauded as a 'wonder drug.'

On 16 February, she will celebrate her fifth 'clean' year and a full decade

has passed since her descent into an anti-depressant-poisoned hell. Not

that she has yet fully escaped.

"It's taken me a long time to put back on the weight that I lost, my weight

plummeted to five stone," she says.

PROZAC NATION

"I also still have the seizures. I'd say it averages out at about nine in a

day although I have the odd day where I've not had any."

Ramo is chair of the UK Prozac Survivors Support Group (PSSG), founded in

March 198 to advise and help people prescribed antidepressants in the

Selective Serotonin Reuptake Inhibitor (SSRI) class. This is the class that

has seen some atrocious side effects.

For the majority of people taking Prozac and similar medications, the impact

of these drugs on their lives has been positive. But Ramo's experience

serves as a grim medical parable. Where the use of medicine hinges upon

theories of 'chemical imbalances', and where drug companies are not fully

open about their possible side effects, a minority of patients are at great

risk.

"I'm no longer battling with anxiety-depression, that's the ironic thing,"

she says. "I've developed seizures through being prescribed these drugs.

I've no longer got the problem for which these drugs were prescribed but I'm

still battling with the problems that the drugs caused."

In August 1991, Ramo's fiancé died suddenly, one month before their wedding.

"I was never offered any bereavement counselling or any alternativeŠI was

just put on tablets and it was downhill from there."

Some months later, while working at Manchester's Fountain Street Employment

Service, she broke down. A visit to the GP led to the instant prescription

of fluoxetine (Prozac). Initially, she was transfused by an unnatural

'high', a manic sense of exaltation. Six weeks later, Ramo crashed,

becoming actively suicidal and haunted by insomnia, anxiety and dread.

Over the next few years each worsening side effect was met with one

response: another prescribed drug. She made several suicide attempts.

"There was one particular one which to be honest, I can't believe how close

I'd come," she says. "Looking back, I can see that I was in a trance-like

state. What actually brought me back to reality was I had Spot my dog who

was a little puppy at the time and he literally jumped up at me as I stood

in front of the bathroom mirror with a knife against my throat, ready to

slit my throat. My first thought was not 'Oh my God! What am I doing?' It

was 'Oh my God! I can't do this in front of Spot."

Ramo recalls the various cocktails of alcohol and pills she would take in

overdose: Sometimes, I'd be unconscious for about a week. The only way I'd

know I'd been out of it was that I'd go into the newsagent, look at a

newspaper date and I'd go 'Oh my GodŠ'

"I'd even started looking into my own funeral arrangements. And this is

somebody who used to live life to the full. I'd never felt down. I thought

'depression' was a case of the Monday morning bluesŠ"

A CHEMICAL IMBALANCE?

It was an angry encounter at the Royal Oldham Hospital in Manchester, with a

psychiatrist who was referred to as a neurologist (Ramo had previously

suffered 23 seizures in a day) that compelled her to research her own drug

therapy. Reading up on Prozac and other case studies set her towards

setting up the PSSG and weaning herself off drugs.

For millions of people, Prozac and its sister anti-depressants are very

helpful, releasing them from much psychic pain. But they are now being

handed out across GPs' desks, for everything from post-natal depression to

menopausal problems. Moreover, they are being marketed with a not fully

proven theory of 'chemical imbalance' that is based on the theory that

topping up the brain's supply of a chemical called serotonin will alleviate

depression.

Just as happened with the earlier so-called 'minor tranquillisers' of the

1960s, the benzodiazepines, including Atavan, Xanax and Miltown, a backlash

may now be imminent. In its own way, this could prove as unhelpful as the

current vaunting of SSRIs as 'miracle drugs', causing them to acquire an

unnecessarily sinister ring.

"It's going to be a replay of the benzodiazepine story." This is the

prediction of UCD -educated psychiatrist Dr David Healy, now based at the

University of Wales, Bangor. "Part of the problem with this will have been

caused by the pharmaceutical industry. The way they handle these things,

trying to deny there are problems means that when people get disenchanted,

they really do get very disenchanted and it's very hard for someone like me

who thinks that SSRIs can be useful to actually prescribe them. So they

move from a situation where they're being overused, to one where they're

being underusedŠ"

BLOWING IN THE WIND

Certainly, the drug companies, previously hailed as the saviours of millions

of depressed people, are now feeling an increasingly chill wind blowing.

The high point so far came in June 2001, when the Glaxo Smith Kline company

had to give $6.4 million to the family of a man who had shot to death his

daughter and grandchildren before turning the gun on himself, while put on

Seroxat (paroxetine) for sleeping problems.

Cases like this, involving aggression or suicide are extremely rare.

However, Seroxat, whose sales match those of Prozac, now looks as though it

could emerge as potentially highly addictive for some people. Last year,

America's Food and Drug Administration (FDA) ordered Glaxo Smith Kline to

warn GPs that for some people, Seroxat packaged as 'Paxil' in the US) could

be as addictive as Valium.

Mark Harvey, a solicitor with the Cardiff firm Hugh James Ford Simey, has

something to say on the subject: "My feeling is GSK knew, and they

certainly know damn well now, their drug had the capacity to cause a lot of

harm to a small number of people. In particular in relation to coming off

it and they're not being honest to either prescribing doctors or patients."

Hugh James Ford Simey has already been contacted by over 120 people,

complaining of problems with Seroxat. They're coming in, says Mark Harvey,

at a rate of nearly three a week. In order to facilitate these people, the

firm is setting up a 'User Group' to form the focus for future litigation

against the drug companies. Many of these people have experienced 'cold

turkey-like symptoms while coming off the drug.

"I've seen an advert in the States. It actually says "Talk to your doctor

about non-habit forming Paxil," says Harvey. "That's outrageous, that's

clearly designed to catch patients and it deals with what they want to know,

which is if it's non-addictiveŠ"

Far from being a zealot against the use of drugs to treat psychological

distress, Dr Healy researched serotonin effects at Addenbrooke's Hospital in

Cambridge, after leaving Ireland.

But as the author of The Antidepressant Era (Harvard Press), he is candid

about the pitfalls of SSRIs, such as Prozac, Seroxat, Lustral and Cipramil.

"The estimates are that one in 20 of us gets so agitated on a SSRI that we

have to stop treatment," he says. "One in 100 of us going on a SSRI will

make a suicide attempt. One in 1,000 might commit suicide. There are other

hazards: probably 30-50% of us going on a SSRI will have problems trying to

withdraw. The withdrawal symptoms will be severe; for some people they may

continue for a year."

MOTHER'S LITTLE HELPER

"It's hard to know how many. It may be only five percent who really have a

severe problem. But if 40 million have gone on Prozac and 100 million have

gone on a SSRI, five percent is five million people so it is a major

problemŠ"

The relentless marketing has apparently repackaged not just the medicines,

but the condition they are used to treat. Depressed people lose serotonin

through 're-uptake' between the brain cells: take an SSRI and you get more

serotonin. But the biology of the brain is barely understood: serotonin

might not be the key to mood and the drugs may not even work by stimulating

it.

Anti-depressants were invented in the mid 1950s and the majority of people

who these days get Prozac or Seroxat would have once been given minor

tranquillisers. Thus when SSRIs were launched, the companies' emphasis was

on 'depression' as a chemical deficiency to avoid association with the minor

tranquillisers, by then known to be addictive.

BEYOND PROZAC

Limerick-based psychiatrist Dr Terry Lynch, author of the book Beyond

Prozac, is highly critical of the way a theory about depression has become

accepted wisdom. This he believes, reflects the doctors' relationship with

the drug companies.

"Certainly, I think psychiatrists and GPs to a certain degree need to feel

that they're the ones driving the whole thing. They're the ones with the

knowledge and the patient's job is to follow the doctor's advice," he says.

"I also think that the pharmaceutical companies are involved here because

over the past 50-60 years, medicine in general but maybe particularly

psychiatry has become very closely aligned to the pharmaceutical industry.

"Psychiatry has allowed itself to become very dependent on the industry for

funding of its meetings, of its research, of its ongoing education. I'm

guessing, but my sense is that the majority of psychiatric post-graduate

meetings are funded by drug companies and I think that that's unhealthy."

Among those people who have approached Hugh James Ford Simey regarding legal

action is Glenys (not her real name), a grandmother with no previous history

of depression. When she suffered her first panic attack, she was showing

symptoms that may well have been hormonal and associated with the menopause.

She did not meet the traditional diagnostic criteria for depression when

given Seroxat.

Previously, she had been given HRT, then Valium and Prozac; the Valium had

caused withdrawal problems, something that is a recognized risk. But Glenys

was not warned about problems coming off Seroxat. It seems she belongs in

the five percent Dr Healy warned would have severe withdrawal. Now off

Seroxat for 18 months, she has been told she may have to wait up to five

years for the physical and mental effects to clear.

"I have never had headaches really, until I started the menopause," she

says. "All I can say it's like it's crushing my head like an eggshell.

After the head, the face will burn, my body will shake and I'll get pins and

needles in my arms. It's just horrendous and the agitation is terribleŠ"

She plans to contribute to the 'Seroxat Users' Group' soon to be set up. In

the meantime, she waits for her problem to clear.

"I just feel it's taken part of my life away. I want to be normalŠI just

hope it hasn't done any permanent damage".

Cardiff firm Hugh James has been instructed to act for the Seroxat Users Group on its lobbying of the Department of Health. The group wants an investigation into the increasing number of reported illnesses connected with the antidepressant drug Seroxat, produced by pharmaceutical giant GlaxoSmithKline.

Partner Mark Harvey is leading the now 400-strong group. He won the instruction through a referral from niche health-related litigation firm Alexander Harris, which acts for the Prozac Users Group.

Harvey has a reputation in this field, having acted on the Roaccutane and Minocycline cases as well as the anti-arthritis drug Opren, which resulted in a successful settlement.

Not all of the group's participants are interested in taking action. Harvey said: "We're not saying the drug's bad; we're saying that not enough people have been warned of the potential symptoms." Some users found it difficult coming off the drug, but GlaxoSmithKline, which has yet to instruct lawyers, maintains that Seroxat is non-addictive.

The Lawyer 9th January 2012, published inaccurate information concerning the currently ‘stayed’ Seroxat litigation which is filed in the High Court of Justice, London.
In response to information having been disclosed to The Lawyer, a number of enquiries have been received concerning the status of the litigation.

In October, 2010 the solicitors then in charge of the case, considered there was insufficient evidence to proceed and advised the litigants to discontinue their claims. Approximately two thirds of the litigants followed this advice.

In the meantime, the experts in the case together with other specialists knowledgeable of the medical problems associated with Seroxat disagreed with the view of the legal team.

On 14th December 2010, evidence from representatives of the litigants, were heard at a
specially convened Legal Services Commission funding review. The outcome of this
meeting was an increase in the likely prospects of success for the litigation, above that
estimated by the solicitors who had led the Group Action. The Legal Services Commission then confirmed it would consider the opinions of the experts before its final determination of the funding certificate bearing in mind, the Group Action now comprised a smaller number of litigants.

The Legal Services Commission is currently considering the favourable opinion of new

Counsel and statements from the experts delivered by a newly instructed legal team; its
response is awaited.

EMA Calls for Withdrawal of Certain Anxiety Medications

January 20, 2012 — The European Medicines Agency (EMA) is recommending suspension throughout the European Union (EU) of all medicines containing meprobamate, a key ingredient in some anxiolytic medications.

The Agency’s Committee for Medicinal Products for Human Use (CHMP) has concluded that the benefits of meprobamate do not outweigh its risks and that all marketing authorizations for oral medicines containing meprobamate be suspended throughout the EU.

A carbamate deriviative, meprobamate is used primarily to treat anxiety disorders, but according to the EMA, it is also used for migraine, digestive disorders, muscle tension or cramps, as well as insominia. It is marketed under the name Equanil and other trade names.

The EMA review of the meprobamate-containing medications was undertaken because of a July 2011 announcement by France's regulatory agency that it intended to suspend marketing authorizations of these agents because of "serious side effects."

After reviewing all available safety and efficacy data of the medications, including data from published studies, postmarketing surveillance, and poison control centers, the CHMP concluded that "there was a risk of serious and potentially fatal side effects, such as coma, in patients taking meprobamate-containing medicines under normal conditions of use. The Committee considered that these risks were increased due to the danger of unintentional overdose because of the small difference between the treating dose and the dose that can harm patient, including elderly people."

The CHMP also noted that there is a risk of addiction that can lead to "serious and sometimes fatal side effects" if patients stop the medication abruptly.

The final word on whether these medications are ultimately to be banned in Europe will be determined by the European Commission.

To avoid the risk of severe withdrawal symptoms and to ensure that prescribers have enough time to determine the most appropriate treatments for individual patients, the Committee has recommended that the withdrawal of the medicines from the market be carried out gradually, within 15 months of the European Committee decision.

In the meantime, the EMA recommends the following:

•Doctors should not start new patients on meprobamate-containing medicines.

•Doctors should review the treatment of patients currently taking meprobamate-containing medicines with a view to switching them to alternative treatments, in line with national recommendations for the condition being treated.

•Prescribers should be aware that the availability of meprobamate-containing medicines will decrease as the withdrawal from the market takes place according to national time frames.

An article, written by Katy Dowell, appeared on thelawyer.com on January 9 2012 that made reference to the current UK Seroxat litigation. Because of legalities I cannot discuss certain aspects of proceedings as they are at a delicate stage at this moment in time.

I can, however, state that the article is based on supposition and, is in fact, wrong.

Katy Dowell writes that a source [lawyer] close to the case informed her that legal aid has been withdrawn from the case. This is untrue.

The public funding certificate [previously known as legal aid] has never been removed from this case.

The Legal Services Commission's Committee considered there was merit in the case, increased the given assessment of prospects of success and agreed that a full review of the evidence should occur.

We are now at the stage where we have presented the Legal Services Commission with evidences to extend further the funding for the Seroxat litigation and we are currently awaiting their decision.

It would be unethical of me at this stage to comment further on matters related to the Seroxat litigation. I have already been contacted by the media and have told them that I cannot comment. My stance still remains the same.

Johnson & Johnson has settled for $158m (£102m) over allegations that a subsidiary defrauded a state healtcare programme in the US state of Texas.

The company is accused of illegal marketing and kickbacks to boost Risperdal, an anti-psychotic drug.

Judges in other states have also ordered the subsidiary, Janssen, to pay millions for similar accusations, but those cases are still under appeal.

The company said it was "committed to ethical business practices".

The state of Texas had been seeking up to $1bn in the suit.

According to court records, the company was accused of targeting "every level" of the Texas Medicaid programme.

Medicaid is a government-backed US public heath programme for low-income citizens.

Texas' Risperdal case was filed by whistle-blower Allen Jones, who alleged the company made false or misleading statements about the drug's safety and effectiveness when compared to other drugs.

Mr Jones, a former employee of the Pennsylvania Inspector General's office, said he learned of Johnson & Johnson's actions in Texas while investigating similar claims in his home state.

The state of Texas joined the suit in 2006.

'Subverted science'

The subsidiary, Janssen Pharmaceutics Inc, said in a statement that the company was "committed to ethical business practices, and has policies in place to ensure its products are only promoted for their FDA-approved indications".

Allen Jones, who will receive part of the settlement, told reporters that while the payment was enough punishment, "this industry will not change its behaviour until executives are prosecuted, until executives actually go to jail for the frauds they perpetrate".

"They trashed the Johnson & Johnson credo and they misused Texas and, I believe, well-meaning officials, to further their marketing aims," Mr Jones said.

"They subverted science and they induced others to betray the people they were supposed to be taking care of. To me that is reprehensible."

Last year, a South Carolina judge ruled Johnson & Johnson must pay a $327m penalty after a jury found it guilty of similar charges. In 2010, a Louisiana jury found the company violated that state's Medicaid fraud act and awarded it $258m in damages.

The company is appealing against the Louisiana verdict and has said it will appeal the South Carolina verdict as well.

Arguments in the Texas trial had already begun on 10 January. At the start of the trial, lawyers for the New Jersey-based health care giant insisted the company did nothing improper in marketing the drug.

Funding also became an issue in the Seroxat Group Litigation Order (GLO). More than 500 claimants joined the GLO against pharmaceutical giant GlaxoSmithKline UK, alleging to have suffered withdrawal effects when reducing, discontinuing or attempting to discontinue use of the antidepressant Seroxat. It was alleged that such suffering amounted to personal injury.

According to a lawyer close to the case the claimant numbers have fallen dramatically as a result of the withdrawal of legal aid. This was made particularly contentious because the firm used to represent the claimants, Cardiff-headquartered Hugh James, revised down the considered success of the case, forming the basis for the withdrawal of state funding.

It is understood that 125 claimants will continue to pursue the action but that they will be looking for a new law firm to represent them. Meanwhile, a group of the remaining claimants are appealing the Legal Services Commission’s decision to cancel the legal aid.

Abstract

Background Based principally on findings in three studies, the collaborative reanalysis (CR), the Women's Health Initiative (WHI) and the Million Women Study (MWS), it is claimed that hormone replacement therapy (HRT) with estrogen plus progestogen (E+P) is now an established cause of breast cancer; the CR and MWS investigators claim that unopposed estrogen therapy (ET) also increases the risk, but to a lesser degree than does E+P. The authors have previously reviewed the findings in the CR and WHI (Parts 1–3).

Objective To evaluate the evidence for causality in the MWS.

Methods Using generally accepted causal criteria, in this article (Part 4) the authors evaluate the findings in the MWS for E+P and for ET.

Results Despite the massive size of the MWS the findings for E+P and for ET did not adequately satisfy the criteria of time order, information bias, detection bias, confounding, statistical stability and strength of association, duration-response, internal consistency, external consistency or biological plausibility. Had detection bias resulted in the identification in women aged 50–55 years of 0.3 additional cases of breast cancer in ET users per 1000 per year, or 1.2 in E+P users, it would have nullified the apparent risks reported.

Conclusion HRT may or may not increase the risk of breast cancer, but the MWS did not establish that it does.

A PROMISING medical student who battled with an eating disorder died when her severely-emaciated body failed to cope with anti-depressants prescribed by her GP mother, a Leeds inquest has heard.

Katie Lumb, 23, was just 5st 8lbs when she died from a toxic build-up of the drugs after asking her mother, a GP, to treat her as a private patient in April last year.

Dr Susan Lumb told the inquest at Leeds Coroner’s Court: “I wasn’t the right person to treat her, I know that. I tried to get across to her but she would not listen.

“I was very much aware that when her mood was low, her appetite went down and she would lose weight.

“I thought it was possible that if her mood lifted, she would eat.”

Her parents had first noticed she had lost a significant amount of weight when she returned to the family home in Sheffield for Christmas in 2008, but she hid the full extent of her anorexia-like condition.

In October 2009 she went to see her GP and was immediately admitted to hospital.

At her lowest ebb, Katie’s weight fell to 4st 9lbs, doctors feared for her life and she spent two months in Leeds General Infirmary being fed through a tube.

When she was fit to be discharged she was referred as an outpatient to the Yorkshire Centre for Eating Disorders at Seacroft Hospital in Leeds.

After she was discharged, Katie, a Leeds University student, failed to keep her outpatient appointments and only attended two out of 12 appointments.

She was eventually dismissed as a patient and throughout 2010 she assured her parents that she was getting help, but by early 2011 she appeared to be suffering from severe anxiety.

She was eventually prescribed the anti-depressant drug citalopram by her mother after she begged for help, but refused to see other professionals.

Tragically, a few weeks later she collapsed three times at her student home but refused all attempts by worried flatmate Miriam Walden to seek medical attention.

Ms Walden told the inquest she had insisted Katie at least call the NHS Direct hotline, but later discovered she had only pretended to make the call.

Katie was discovered dead in the bedroom of her shared student house in Leeds, the following day.

Recording a narrative verdict, West Yorkshire coroner David Hinchliff said: “A post mortem examination shows the cause of death to be citalopram toxicity.

“This was caused by a disorder of metabolism and impaired kidney function, relating to her dangerous low body weight which would have caused a build-up of the drug within her system to a fatal level.

“Her degree of emaciation and malnutrition has contributed to this by causing changes in the beating mechanism of her heart.”

The government's plans to reform welfare were badly hit on Wednesday when it suffered three defeats in the House of Lords on proposed benefit cuts.

Plans to means-test employment and support allowance (ESA) payments for disabled people after only a year were rejected by peers.

The means test would have applied to cancer patients and stroke survivors, and was denounced by Lord Patel, a crossbencher and former president of the Royal College of Obstetricians, as an immoral attack on the sick, the vulnerable and the poor. "If we are going to rob the poor to pay the rich, then we enter into a different form of morality," Patel said.

The government was defeated by 224 votes to 186, even though Lord Freud, the welfare minister, claimed that the cost of the amendment would be £1.6bn spread over five years.

The other defeats were over plans to time-limit ESA for those undergoing cancer treatment, and to restrict access to ESA for young people with disabilities or illness.

The defeats do not augur well for the government's chances in future votes in the Lords on the bill, which includes housing benefit caps. The bill is at report stage before returning to the Commons.

Some peers warned the Lords they should not vote down the measure to restrict ESA payments to a year since the cost of doing so would be so high and MPs would be certain to reverse the result. Patel, backed by the shadow welfare minister, Lord McKenzie, proposed that the government's plan to time-limit contributory ESA to a year should be extended to two years. At that point, irrespective of how much someone has paid into the system, a means test set at an income of £16,000 would start to apply, leading to annual cuts in benefit of £94 a week.

Freud countered that the 365-day time limit was not arbitrary and was similar to limits imposed in France, Ireland and Spain, and struck a "reasonable balance between the needs of sick, disabled people claiming benefit and those who have to contribute towards the cost".

He said one year was the right balance between restricting costs and allowing people to adapt to their changed circumstances and was double the time allowed for contributory jobseekers' allowance.

With a few exceptions, the Liberal Democrats voted with the government as they generally have throughout the divisions in the Lords on the welfare bill, but their support was overwhelmed by a big turnout from Labour and crossbenchers. The Labour peerage is armed with welfare experts including Lady Lister and Lady Hollis.

Crossbenchers have also been furiously lobbied by disability campaigners arguing that they should not be made to suffer for the economic crisis.

Many Liberal Democrats have been uncomfortable voting with the government, but feel forced to do so if they are to abide by their coalition commitment to bring the deficit under control.

In a report out on Thursday, the Commons public accounts committee finds that fundamental changes to the benefits system, including the introduction of a new means-tested universal credit to replace some existing means-tested benefits, may fail without the formation of a new body.

Margaret Hodge, the chair of the committee, said that the government must learn from past experience and co-ordinate benefits more effectively.

"At present, there are nine central government departments and 152 local authorities administering 30 different means-tested benefits, yet there is no one body responsible for co-ordinating means-testing across government," she said.

"There needs to be a single body responsible for overseeing the interaction between different benefits, means-tested or not, and ensuring consistency and value for money."

A DWP spokesman said: "This report highlights exactly why we need universal credit. It has been designed across departments with the benefits and challenges raised by the PAC in mind.

"It will mean more people getting the money they are entitled to whilst reducing complexity and fraud in the system."

Buttram is a notoriously vile anti-vaccine crank, conspiracy theorist and promoter of dubious practices and alternative medicine. A sympathetic presentation is here. He is also a member of the infamous Association of American Physicians and Scientists, which publishes Journal of American Physicians and Surgeons (discussed here)

and uses Andy Schlafly as legal representative.

Dr. Buttram is perhaps most infamous for claiming that the shaken baby syndrome is really due to vaccine injury rather than physical trauma and has published articles in his Association’s journal and elsewhere defending that claim. As a consequence he was personally responsible for almost getting baby murderer Alan Yurko off the hook (another witness for the defense was Mohammed Al-Bayati). As if the facts don’t prove his lunacy, Dr. Buttram also has his own page on Whale.to. That should settle it.

Diagnosis: Unintentionally evil loon of the kind that is all too common. Needs to be stopped, but even if he is there’s ten more to take his place.

If there's one thing that a crank, quack, pseudoscientist, or anti-vaccine propagandist doesn't like, it's having the light of day shined upon his activities. In fact, so much do they hate it that they have a distressing tendency to respond to science-based criticism not with science-based rebuttals (mainly because they can't given that they don't have any science to support them) but rather with legal threats. Sometimes these legal threats progress beyond just threats and into legal action, usually libel suits designed not to be compensated for damage to reputation but rather to intimidate and silence. We've seen it before many, many times, directed against journalists, bloggers, and scientists as varied as Simon Singh, Paul Offit, Amy Wallace, Andy Lewis, and others. Sometimes these efforts reach downright comical excesses, as it did when PR flack Marc Stephens threatened bloggers on behalf of the Burzynski Clinic, but they're only comical to observers. If you happen to be on the receiving end of these legal threats, you have little choice but to take them at least a little seriously, and, like all bloggers, I am not immune to at least a mild degree of worry that some day some crank will decide to take a legal shot at me, too. Fortunately, I live in the U.S., where libel laws make suing much less hospitable, thanks to the First Amendment.

It looks as though an anti-vaccine crank is at it again.

Apparently not satisfied with having taken a run at Brian Deer and lost, even in the libel-friendly venue of the UK, disgraced anti-vaccine "brave maverick doctor" Andrew Wakefield has apparently filed a libel suit against Brian Deer on January 3. A PDF of the complaint can be found here. Apparently, Wakefield is very, very unhappy at the most recent series published by Brian Deer in BMJ almost exactly a year ago today in which Deer characterized Wakefield's research as "Piltdown medicine." He explained why, too, in an article entitled How the case against the MMR vaccine was fixed, while BMJ editor Fiona Godlee piled on with an accompanying editorial entitled Wakefield's article linking MMR vaccine to autism was fraudulent. As is usual for Deer's work, the articles were well-researched and well-referenced. Clearly, they had an effect, too, continuing Wakefield's slide from "brave maverick doctor" that the media liked to trot out as a "vaccine skeptic" whenever doing stories about vaccines to a pathetic crank who could only score invitations to speak at antivaccine conferences. Not surprisingly, Wakefield's admirers immediately started a counterattack.

And the antivaccine movement is still smarting from Deer's dismantling of the entire basis of its hero's stature. Indeed, just one month ago, the Boy Wonder of the antivaccine crank blog Age of Autism went after Anderson Cooper's writer/producer eleven months after an interview he did with Wakefield around the time Brian Deer's story came out last January. It's another example of the one trick of AoA's one trick pony, in which its Boy Wonder goes all Kevin Bacon "six degrees of separation" on Anderson Cooper's producer in order to find a tenuous--fantastical, even--apparent conflict of interest. Throughout it all, J.B. Handley's happy home for antivaccine propagandists published post after post after post attacking Brian Deer, Fiona Godlee, and the BMJ. It's become an obsession with AoA's bloggers and the antivaccine crankosphere.

So what is in Wakefield's complaint against Brian Deer? Well, it's the usual stuff, in particular claiming that the content of the BMJ articles by Deer and BMJ editors was not only just false but knowingly false, stating:

The Defamatory Statements were and are false and written and published with actual malice and intended to cause damage to Dr. Wakefield's reputation and work as a researcher, academic, and physician and to permanently impair his reptation and his livelihood.

Wakefield's attorney even has the audacity to play the "pharma shill" gambit:

Interestingly, at the time of the editorials and the Deer article were Published, the Defendents failed to disclose the fact that the BMJ received significant revenue from the very vaccine manufacturers whose products need further investigation. It was only monthslater, after the issue was raised by others, that the BMJ posted the following: "The BMJ should have declared competing interests in relation to this editorial by Fiona Godlee and colleagues. The BMJ Group receives advertising and sponsorship revenue from vaccine manufacturer, and specifically from Merck and GSK, which both manufacture MMR vaccines."

Yes, indeed. Wakefield's attorneys are actually trying to argue that the BMJ libeled Wakefield to protect its big pharma sugar daddy, the vaccine manufacturers. Seriously, his lawyer, William M. Parrish, should know better. Or maybe he doesn't. He doesn't list libel as one of his areas of specialty, which are listed as intellectual property disputes (e.g., trade secret, trademark, trade name, trade dress, copyright and patent disputes) business torts (e.g., unfair competition, deceptive trade practices, tortious interference with actual and prospective contracts and/or business relationships, fraud, breach of fiduciary duty, unfair advertising practices, etc.) and breach of contract claims. Yet here he is, suing for libel.

I find it very amusing that Dr. Wakefield claims his "professional reputation" was damaged by Deer's most recent article The reason, of course, is that Dr. Wakefield's reputation was destroyed by his having done and publicized his bad science, by his having intentionally consorted with the antivaccine movement and continued (in my opinion) to crank out bad science in the service of smearing the MMR with the claim that it causes autism. Wakefield destroyed his own reputation by doing fraudulent science. That happened years before Brian Deer ever wrote that BMJ article a year ago. Wakefield had already been found guilty by the General Medical Council of "serious professional misconduct," which included acting in ways not in the clinical interests of disabled children. Shortly after that, he was struck off the medical register, and fired from Thoughtful House. All of this happened many months before Brian Deer wrote his article.

To but it bluntly, Andrew Wakefield no longer had any professional reputation to be trashed. This will be a major problem for him in any libel action, because one has to prove damage to one's reputation to be successful in a libel suit.

All that leaves to me is one question: Why? And Why now? Not being a lawyer, I can only speculate based on what I know about the Wakefield case. Mr. Parrish must know that his client is incredibly unlikely to win this action. After all, Wakefield has already been tried and found guilty of misconduct by the British GMC and suing Brian Deer for libel, even in the plaintiff-friendly UK, backfired on him spectacularly. There's little reason to expect that, given how well Deer has put all his ducks in a row in his reporting time and time again, Wakefield will do better in a U.S. court, where the bar for proving libel is much higher than in the UK. So, again, why is he doing this now? Let me speculate a moment. My guess is that the purpose of this libel action is to punish Brian Deer. More importantly, I'd also bet that it's designed to give Andrew Wakefield a soapbox and a means of putting himself back into the public spotlight again, the spotlight from which he's faded so much since one year ago. Again, he'll be the "persecuted brave maverick doctor," but this time he'll be perceived as fighting back. I just hope he knows that Texas has a new anti-SLAPP law. Wakefield had better be careful.

In fact, this whole lawsuit strikes me as incredibly ill-advised, as it opens Wakefield up to discovery. Of course, it might well be that part of the motivation for the lawsuit is to subject Brian Deer, the BMJ, and Fiona Godlee to discovery, and I wouldn't be the least bit surprised to see bits of information from discovery show up on the antivaccine crank blog Age of Autism; that is, if the case gets that far. If I were part of the antivaccine bloggerati at AoA, I might be worried now, because, given AoA's campaign to discredit Brian Deer, particularly over the last year, it's likely to be in the defense's crosshairs. Communications between Wakefield and any AoA blogger might be subject to discovery. Any financial transaction between Generation Rescue and Andrew Wakefield could also be subject to discovery. Wakefield might think that because Deer, Godlee, and the BMJ are in the UK that they won't engage in a full and vigorous defense to the extent of going whole hog (sorry, the lawsuit's in Texas; I couldn't resist) on discovery. Is Wakefield sure he wants to risk that? BMJ is part of a large company, and publishing companies tend not to take kindly to libel actions. Of course, even if the Generation Rescue/AoA/Wakefield connection isn't a worry, everything else is. After all, everything about the Lancet paper would definitely be subject to discovery, and there's no question about its relevance to the lawsuit.

Whatever Wakefield's motivation, this move reeks of desperation. After all, if this was such obvious libel, why did Wakefield wait nearly a full year after the publication of Deer's BMJ articles until filing this lawsuit? In taking this action, Wakefield is both demonstrating the characteristics of a crank (the need to silence using the courts rather than to refute using science) and showing just how far he's fallen. In any case, I highly doubt Brian Deer has anything to worry about, other than the irritation this might cause and whether the company providing his libel insurance will go all wobbly on him. After all, the truth is an absolute defense against libel.

Poor Andy. Once upon a time, he had the power to kill children just by doing some very bad science and writing a few very bad papers, and now he's reduced to living in Texas and being supported by mobs of New Age cranks. He's powerless and bored, but his ego is still being inflated by sycophants…so what does he do? He decides to sue the British Medical Journal and journalist Brian Deer for defamation.

He has no medical career left. His entire life is now tied to his anti-vaccine crusade, and he's got nothing to contribute, other than his status as a martyr to the cause, so what he's done now is crawled up on a cross and is asking for more nails to be hammered in. He knows he can't lose in the grand scheme of things; if he wins the court case (which won't happen), he's a hero; if he loses (the inevitable result), he's a victim of the evil forces of Big Pharma, and his defeat proves that the bad guys are out to get him, so he must be right.

The new data from the U.K.’s National Health Service (NHS) Information Centre shows antidepressant use alone rose 28 percent between 2007/08 and 2010/11 in England. Just under 34 million prescriptions were dispensed for antidepressants in 2007/08, rising to 43.4 million in 2010/11.

The use of anti-anxiety drugs rose from just over six million to 6.5 million in the same period (an 8 percent jump), while prescriptions for sleeping pills rose 3 percent from around 9.9 million to 10.2 million.

Meanwhile, prescriptions for barbiturates, which promote sleep and reduce anxiety, have dropped 51 percent from just over 22,000 to just under 11,000. Across all these groups of drugs, there was a 20 percent rise in prescription items dispensed between 2007/08 and 2010/11.

Paul Farmer, chief executive of the UK mental health charity Mind, told the UK Press Association there were several factors that could lead to increased prescription figures. “The tough economic times may have contributed to more people experiencing depression,” he said, “but improved awareness around mental health problems may also mean more people are seeking help for their problems, with doctors also getting better at spotting symptoms.

“It’s important to remember that antidepressants can be a lifeline for some people which enable them to manage their mental health problems. It is worrying that antidepressants can be the first port of call for some doctors, despite the fact that ‘watchful waiting’ and talking therapies are recommended as the first line of treatment for mild to moderate depression.”

In addition, Farmer said there was a lack of access to counseling and psychotherapy in some parts of the country “which means doctors are left with little choice but to prescribe medication.” He added: “Last year Mind found that one in five people still have to wait over a year to access talking therapies.”

Still, some experts urge caution in interpreting the NHS figures. In April 2011, NHS data on a 43 percent jump in prescriptions for the SSRI class of antidepressants from 2006-2010 launched a media bandwagon declaring an epidemic of depression and blaming economic woes.

But Dr. Ben Goldacre, a physician, academic and author, noted that the jump was nothing new: a British Medical Journal article in 2009 found in the five-year period from 2000 to 2005 antidepressant prescribing also increased, by 36 percent.

“This isn’t very different from 43 percent, so it feels unlikely that the present increase in prescriptions is due to the recession,” Goldacre wrote in his blog for the Guardian newspaper, “Bad Science.”

As it turned out, closer examination of the data from 2000-2005 found that there was not necessarily more depression being diagnosed, nor that the rise in the overall number of antidepressant prescriptions was due to increasing numbers of patients receiving antidepressants.

“It was almost entirely caused by one thing: a small increase in the small proportion of those patients who received treatment for longer periods of time.

“Numerically, people receiving treatment for long periods make up the biggest chunk of all the prescriptions written, so this small shift bumped up the overall numbers hugely,” Goldacre wrote.

Based on some of the discussions about allergies, nutrient deficiencies, et cetera causing schizophrenia, I thought that this list of medical conditions that cause or are associated with schizophrenia-like symptoms might be interesting. Individuals suffering psychotic symptoms as a result of these should most likely not be classified as suffering from schizophrenia; rather, the diagnosis should probably be Psychotic Disorder Due to a General Medical Condition and the patient treated accordingly. This is part of the differential diagnosis. You can imagine the problem if the physician misdiagnoses the illness based only on the symptoms. The problem is compounded when a family member concludes, for example, that megavitamin therapy is the solution for schizophrenia because their loved one suffered psychosis because of a vitamin B12 deficiency and the doctor diagnosed schizophrenia without checking alternatives. Not only does this add to the anecdotal confusion about schizophrenia, it adds to the suffering of all concerned because of a misdiagnosis.

Our current advice to women with questions about PIP breast implants remains to seek advice from their consulting surgeon.

There is no evidence of increased rupture rates associated with PIP implants. A group lead by NHS Medical Director Professor Sir Bruce Keogh is currently reviewing the data on rupture rates of these implants and is due to release its findings on Friday.

Following the announcement in France today, the Medicines and Healthcare products Regulatory Agency (MHRA) is not recommending routine removal of PIP silicone gel breast implants in the UK.

We recognise the concern that some women who have these implants may be feeling but we currently have no evidence of any increase in incidents of cancer associated with these implants and no evidence of any disproportionate rupture rates other than in France.

We therefore do not believe that the associated risks of surgery from breast implant removal can be justified without further evidence.

We will continue liaising with the French medicines and medical devices regulator and we are awaiting the evidence to support the decision made in France. This will be evaluated as a matter of priority by our clinical and toxicological experts and we will issue further advice if necessary.

In the absence of strong clear evidence to the contrary, we see no reason to alter our current advice that there is no need to routinely remove these PIP breast implants.

In the meantime we would recommend that all patients who have questions about their PIP breast implants should seek advice from their implanting surgeon.

We had discussions on 21 December 2011 with other health or regulatory experts from France, the Netherlands, Portugal, Italy, Ireland, Hungary, Austria, Denmark and Malta. They all agreed that there was no evidence of any increase in incidents of cancer associated with PIP breast implants and no evidence of any disproportionate rupture rates other than in France. Information obtained from the Australian Regulatory Authority (TGA) is consistent with the figures from all the above European countries other than France in terms of rupture. They have no reported cases of lymphoma.

We have continually monitored the safety of these breast implants. In March 2010 we advised clinicians not to implant these devices and at the same time advised patients who were concerned about their PIP implants to consult their implanting surgeon. MHRA commissioned toxicity testing on the unapproved silicone gel used to fill PIP breast implants, including genotoxicity and chemical toxicity. The results of these tests have been discussed with relevant experts and we have concluded that there is no safety issue related to this filler material. Similar testing carried out by the French medicines and medical devices regulator confirmed these conclusions.

GlaxoSmithKline Plc (GSK), the U.K.’s biggest drugmaker, plans to appeal fines levied by Argentina’s government over a lack of documentation in a company-funded study of the Synflorix vaccine against pneumococcal disease.

Glaxo and two researchers working on the trial were fined 1 million pesos ($232,200) by the Argentinean National Administration of Medicine, Food and Technology, the newspaper La Nacion reported today. The agency cited the drugmaker for a lack of documentation of patient records and administration of medicines, breaches of security controls and irregularities in authorization for the children to participate, La Nacion said.

The fines related to “administrative conduct” of the trial, the London-based company said in an e-mailed statement. Glaxo said that it disagrees with the agency’s ruling and plans to appeal against court proceedings.

“It is important to note that the ANMAT’s ruling does not in any way question the safety of the study vaccine, Synflorix,” Glaxo said. “The ANMAT’s ruling relates to the clinical trial process and not the vaccine,” which was approved by the agency for sale in 2009.

The study, dubbed Compas, was completed in June in the Argentinean provinces of Santiago del Estero, Mendoza and San Juan, Glaxo said. Almost 24,000 children between the ages of 6 and 16 weeks were enrolled in the trial in Argentina, Colombia and Panama beginning in 2007, according to a description on the U.S. government website clinicaltrials.gov.

Synflorix had global sales of 221 million pounds ($346 million) in 2010, according to data compiled by Bloomberg.

Following the announcement in France today, the Medicines and Healthcare products Regulatory Agency (MHRA) is not recommending routine removal of PIP silicone gel breast implants in the UK.

We recognise the concern that some women who have these implants may be feeling but we currently have no evidence of any increase in incidents of cancer associated with these implants and no evidence of any disproportionate rupture rates other than in France.

We therefore do not believe that the associated risks of surgery from breast implant removal can be justified without further evidence.

We will continue liaising with the French medicines and medical devices regulator and we are awaiting the evidence to support the decision made in France. This will be evaluated as a matter of priority by our clinical and toxicological experts and we will issue further advice if necessary.

In the absence of strong clear evidence to the contrary, we see no reason to alter our current advice that there is no need to routinely remove these PIP breast implants.

In the meantime we would recommend that all patients who have questions about their PIP breast implants should seek advice from their implanting surgeon.

We had discussions on 21 December 2011 with other health or regulatory experts from France, the Netherlands, Portugal, Italy, Ireland, Hungary, Austria, Denmark and Malta. They all agreed that there was no evidence of any increase in incidents of cancer associated with PIP breast implants and no evidence of any disproportionate rupture rates other than in France. Information obtained from the Australian Regulatory Authority (TGA) is consistent with the figures from all the above European countries other than France in terms of rupture. They have no reported cases of lymphoma.

We have continually monitored the safety of these breast implants. In March 2010 we advised clinicians not to implant these devices and at the same time advised patients who were concerned about their PIP implants to consult their implanting surgeon. MHRA commissioned toxicity testing on the unapproved silicone gel used to fill PIP breast implants, including genotoxicity and chemical toxicity. The results of these tests have been discussed with relevant experts and we have concluded that there is no safety issue related to this filler material. Similar testing carried out by the French medicines and medical devices regulator confirmed these conclusions.

4) The MHRA informed UK healthcare professionals about the FDA’s communication via a medical device alert issued in February 2011.

The MHRA also continued to review available evidence for association of cancers of women with breast implants in consultation with the relevant UK professional bodies for breast surgery and surgical oncology and has concluded that there is no evidence to indicate an association with cancer. Additionally the MHRA worked with the Cancer Registry and could find no evidence for an association. The MHRA has not received any reports of women with breast implants of any type in the UK with a diagnosis of anaplastic large cell lymphoma (ALCL).

Also, the MHRA consulted with experts to discuss whether there was any danger to babies having been breast fed by mothers with these implants. It was concluded that there were no safety issues.

5) Based on reports to the MHRA from our Adverse Incident Centre (AIC) approximately 1% of women in the UK with PIP breast implants have suffered implant failure, including rupture. This contrasts with information from the French medical device regulatory authority, AFSSAPS, which suggests a failure rate, including rupture, of around 5% in France.

6) The MHRA is the government agency responsible for ensuring that medicines and medical devices work, and are acceptably safe. No product is risk-free. Underpinning all our work lie robust and fact-based judgements to ensure that the benefits to patients and the public justify the risks. A High Court action for damages by a Dublin sports shop owner against the Church of Scientology has ended after out of court talks.

The case taken by Mary Johnston was expected to last until May. However, Mr Justice Peart was told at lunchtime today that the case appeared to be settled.

No details of the settlement were disclosed but costs in the action are estimated to be around €2 million.

Mary Johnston joined the Church of Scientology in 1992.

In her legal proceedings against the Church and three members of the Dublin Mission, she claimed she suffered a personality charge after being sucked into the grasp of the church and subjected to mind control techniques.

She claimed efforts were made to prevent her leaving the church and to silence, devalue and intimidate her and prevent her taking her legal proceedings.

She claimed she suffered psychological and psychiatric injuries.

Ms Johnson's legal action against the Church of Scientology and three of its members - John Keane, Tom Cunningham and Gerard Ryan - began three and a half months ago.

REVENUES HAVE plummeted at the Irish branch of the controversial Church of Scientology, which remains deep in the red.

Membership of the worldwide church, established in 1954, includes movie stars such as Tom Cruise and John Travolta.

However, documents show that interest-free loans from abroad are propping up the Irish branch, which is more than €688,000 in the red in its latest accounts.

According to financial documents lodged by the Church of Scientology Mission of Dublin Ltd, the company’s revenues more than halved from €484,070 to €193,509 in 2009.

As a result of this 60 per cent drop, the church’s operating surplus fell 74 per cent, from €271,804 to €68,292.

The accounts are for the 12-month period to the end of April 2009, but were only signed off by the board on July 20th last after a long delay by the company in lodging the return.

The last occasion the company filed accounts was in October 2008.

Last night the non-executive director of the Church of Scientology Mission of Dublin, Gerard Ryan, blamed the recession for the drop in revenues. “We are not immune to the economic circumstances of the wider community and clearly this has impacted on our fundraising efforts,” he said.

Mr Ryan said the church “raises funds by the sale of our scriptures in the form of books, audio recordings and DVDs. We also raise funds via the extensive study courses in our scriptures that we provide, and the spiritual counselling that lies at the heart of our practice.”

He said the church’s numbers in Ireland were “difficult to quantify, but it is several hundred, and there are more than last year”.

Mr Ryan said the accumulated deficit “is largely due to a legal case some time back which lasted several years. We have been reducing the deficit year by year, and we expect to continue to do so.”

He added: “I’m very confident that this can be continued.”

Asked how the church performed from a financial point of view in 2010, Mr Ryan declined to say, stating that the accounts for 2010 were still not finalised.

The Irish branch is part of a global movement established by deceased US author L Ron Hubbard. It has more than 9,000 churches, missions and affiliated groups in 165 countries.

Scientologists believe Hubbard discovered the fundamental truths of existence and they revere him as “the source” of the religion.

Mr Ryan said: “I strongly believe that our church will continue to grow, both in Ireland and worldwide . . . Our growth in Ireland has been slow but steady, which is understandable in such an overwhelmingly Judaeo-Christian country.”

Hubbard established a Dublin mission in 1958, but it closed in the early 1960s. However, in the early 1990s, Scientology established its current Irish base on Middle Abbey Street in Dublin.

The movement’s directors, Ann-Marie Ryan, Siobhán Ryan and Gerard Ryan, confirm that “the deficit has been funded by loans from members of the Church of Scientology worldwide and other Church of Scientology missions”.

The directors state that as there are no fixed repayment arrangements on the interest-free loans, they “will be repaid at the discretion of the directors when future cash resources permit, which in turn is dependent on generating future surpluses”.

The Scientologist father lives in a complex with other Scientologists and the father is instructed by a church chaplain to take away the sons Lexapro so he locks the medication in his truck. On February 16th with ready access to a loaded gun, the son shot himself in the head."

Here are more details:

Kyle Brennan was born in Virginia in 1986 and was baptized a Catholic.

He was buried a Catholic by his mother, Victoria, in 2007.

Kyle died whilst visiting his Scientologist father (Tom Brennan), in Clearwater, in 2007. Kyles father, being a Scientologist, and being apposed Psychological medicine, pilfered Kyles medication and hid it overnight in his truck.

When Tom Brennan returned home that evening, Kyle had shot himself in the head.

Finding his son dead, Tom Brennan called the Church of Scientology and, after a long discussion, they decided to send Jerry Gentile to Toms Apartment.

Jerry Gentile arrived 45 minutes later.

Jerry Gentile is married to Denise Miscavige (the sister of DAVID MISCAVIGE, the Head of the Church of Scientology).

David Miscavige took the decision to call 911 and request an ambulance for Kyle.

This telephone call was made roughly 90 minutes Kyle Brennan was found dead.

Kyle Brennan, like Lisa McPherson before him, was declared Dead on Arrival at hospital.

The Clearwater Police found Kyles medication hidden in Tom Brennans truck the next day.

Kyle's father was more concerned with protecting the interests of the Church of Scientology that he was of saving his son's life.

He was also guilty of negligent homicide by depriving his son of his medication.

Clearwater - A mother has filed a wrongful death lawsuit against the Church of Scientology, its Flag Service Organization and three parishioners, claiming they brought about her son's death by denying him access to his antidepression medication.

Among the three parishioners named as defendants: Denise Gentile, the twin sister of the church's current worldwide leader, David Miscavige, as well as her husband, Gerald Gentile.

The lawsuit stems from the death of Kyle T. Brennan, 20, who shot himself in the head on Feb. 16, 2007, in Clearwater, while visiting his father, who is a Scientologist.

Police determined the death was a suicide, but Victoria Britton, the young man's mother, said Scientologists are responsible.

Filed in Tampa federal court Friday, the lawsuit claims Gentile and her husband persuaded Kyle Brennan's father to take away his Lexapro, which his son was taking for depression and anxiety.

The suit, which also names Thomas Brennan as a defendant, states that the defendants tried to put Kyle Brennan into a Narconon drug treatment program.

Kyle Brennan was not a Scientologist, the suit states.

The suit is being brought by attorney Ken Dandar, well-known for his extended legal battle against Scientology during the Lisa McPherson case. McPherson, a 36-year-old Scientologist, died in 1995 while in the care of church staffers in Clearwater.

Scientology spokesman Tommy Davis said the lawsuit is an attempt to "draw the church into something that we don't have anything to do with."

None of the Scientologists named as defendants were church staff members, he said. They were all just parishioners. And Davis emphasized that the events took place on private property without church involvement.

Even Narconon, the drug treatment program that uses L. Ron Hubbard's teachings, is a separate entity from the Church of Scientology, he said.

Still, the case draws attention to Scientology's opposition to psychiatric drugs like Lexapro, which it deems to be mind-altering.

The Web site for Lexapro warns users not to go off their medication suddenly, even if they are feeling better. Changes in dosage, it says, can cause patients on antidepressants to worsen their depression, show signs of mood changes and exhibit thoughts of suicide.

Before his death, Kyle Brennan lived at home in Charlottesville, Va., where he was attending college, Dandar said. He was in the second year of a liberal arts degree when he left school and traveled around the country, Dandar said.

Kyle Brennan made a number of stops, going as far west as Hawaii, but in February 2007 he found his way to Clearwater, to stay with his father, whom he hadn't seen since the summer before.

Dandar said Kyle was taking a 10 mg dose of Lexapro, which he descried as "moderate." It was prescribed for him in early 2006 to help him with depression and anxiety.

He continued to use the drug while staying in his dad's two-bedroom apartment at 423 Cleveland St. in Clearwater, Dandar said.

But a week into the stay, Denise Gentile and her husband prevailed upon Kyle's father to take away the Lexapro medication and lock it in his truck, the lawsuit alleges.

While Scientology spokesman Davis said Denise Gentile was not in any authority position at the church, the suit alleges she had the title of "chaplain" and was held up as an authority of sorts on helping families with emotional matters.

The Gentiles and Brennan also phoned Britton, the young man's mother, to try to persuade her to put Kyle in Narconon, the lawsuit states.

The mother, who is not a Scientologist, was adamant that she and her son did not want anything to do with the drug treatment, the lawsuit states. She insisted that her son be put back on Lexapro.

The medication remained locked away, the suit states.

On Feb. 16, 2007, just after 11 p.m., Kyle Brennan shot himself with a loaded .357 Magnum that he found in his father's apartment, the lawsuit states.

His father found him dead, his head slumped in a laundry basket.

The lawsuit said it is unclear how he got ahold of the gun, but it blames "one or more of the Defendants."

"They locked up his medicine, but not the loaded .357 Magnum. That's the story line," Dandar said. "I think that's the case."

Thomas Brennan did not return a phone call left on his voice mail. Neither Denise nor Gerald Gentile could be reached for comment.

Victoria Britton filed suit in 2009 over the death of her 20-year-old son, Kyle Thomas Brennan, after he visited with his father in Clearwater, Fla., in February 2007.

Kyle Brennan had allegedly been the victim of an assault days earlier, but he was taking Lexapro antidepressants consistently.

Concerned that his son was suicidal, Thomas Brennan, a Scientologist, contacted a counselor with church, according to the complaint. But the Thomas' auditor with the church, Denise Gentile, allegedly advised him to take his son's medication away even though Kyle was not a Scientologist himself.

Less than 24 hours after taking away Kyle's antidepressants, the young man "was dead from a single shot of a 357 magnum handgun inside the father's bedroom," according to the complaint.

Kyle's psychiatrist allegedly said that stopping the antidepressants so abruptly, coupled with Kyle knowing he could not have them, exasperated his mental condition.

The defendants Britton had sued - the Church of Scientology Flag Service Organization, Denise Gentile, Gerald Gentile and Thomas Brennan - moved for summary judgment last year, claiming a lack of evidence.

U.S. District Judge Steven Merryday granted that motion on Dec. 6, noting that Kyle had contacted more than 24 governmental agencies to initiate criminal proceedings against most of his immediate family before arriving at his father's home.

"The record is clear that Kyle soon relinquished his Lexapro to his father, who is the sole source of testimony about the attendant circumstances," Merryday wrote. "The father reports that Kyle - acting unilaterally and voluntarily - presented the Lexapro to his father and said, 'I hate this shit. It makes me sick.' Kyle's father claims he took the Lexapro to a local library, researched the pharmacology of Lexapro, and placed the Lexapro in the trunk of his car. No other direct evidence or permissible inference describes the circumstances of Kyle's surrendering the Lexapro to his father."

Britton had claimed the "smoking gun" of her case was a communication from Gentile's supervisor, who said, "Get your son moved out and get him set up somewhere so that he can be handled,"

Merryday disagreed. "This entry shows that an ethics officer within Scientology advised an active practitioner of Scientology to move a troubled non-Scientologist from the practitioner's residence and to somewhere that assistance was available for the non-member," he wrote. "No evidence exists that anything at all occurred as a result of this entry, no evidence exists that Denise Gentile did anything because of this entry, no evidence exists that Kyle's father did anything because of this entry, and no evidence exists that anything either happened or failed to happen to Kyle because of this entry."

"The plaintiff's tendered explanation of the meaning of the term 'handled' within Scientology adds little or nothing to support the plaintiff's extravagant claims," he added.

The Church of Scientology is not responsible for Kyle having access to a handgun, Merryday found.

"No evidence suggests that Scientology or the Gentiles knew of the handgun in even the remotest manner or had reason to suspect the presence of the handgun in the father's apartment," the 24-page decision states. "Both Scientology and the Gentiles are in this record utterly unconnected to the handgun and the ammunition."

Merryday said that "a close and objective examination of the extensive record developed in this action confirms the soundness of the defendants' attack on the plaintiff's claim."

"The plaintiff's claim of Scientology's complicity in, and responsibility for, Kyle's death remains a mere hypothesis that is without essential support based upon reasoned and direct inference from the available evidence," he added. "In particular and in a manner fatal to the plaintiff's claim, the available evidence leaves irreparable gaps in the plaintiff's proposed historical sequence and irreparable gaps in the causal relation between persons and events and their respective consequences."

Abnormality in auditory processing underlies dyslexia

People with dyslexia often struggle with the ability to accurately decode and identify what they read. Although disrupted processing of speech sounds has been implicated in the underlying pathology of dyslexia, the basis of this disruption and how it interferes with reading comprehension has not been fully explained. Now, new research published by Cell Press in the December 22 issue of the journal Neuron finds that a specific abnormality in the processing of auditory signals accounts for the main symptoms of dyslexia.

"It is widely agreed that for a majority of dyslexic children, the main cause is related to a deficit in the processing of speech sounds," explains senior study author, Dr. Anne-Lise Giraud and Franck Ramus from the Ecole Normale Supérieure in Paris, France. "It is also well established that there are three main symptoms of this deficit: difficulty paying attention to individual speech sounds, a limited ability to repeat a list of pseudowords or numbers, and a slow performance when asked to name a series of pictures, colors, or numbers as quickly as possible. However, the underlying basis of these symptoms has not been elucidated."

Dr. Giraud and colleagues examined whether an abnormality in the early steps of auditory processing in the brain, called "sampling," is linked with dyslexia by focusing on the idea that an anomaly in the initial processing of phonemes, the smallest units of sound that can be used to make a word, might have a direct impact on the processing of speech.

The researchers found that typical brain processing of auditory rhythms associated with phonemes was disrupted in the left auditory cortex of dyslexics and that this deficit correlated with measures of speech sound processing. Further, dyslexics exhibited an enhanced response to high-frequency rhythms that indirectly interfered with verbal memory. It is possible that this "oversampling" might result in a distortion of the representation of speech sounds.

"Our results suggest that the left auditory cortex of dyslexic people may be less responsive to modulations at very specific frequencies that are optimal for analysis of speech sounds and overly responsive to higher frequencies, which is potentially detrimental to their verbal short-term memory abilities," concludes Dr. Giraud. "Taken together, our data suggest that the auditory cortex of dyslexic individuals is less fine-tuned to the specific needs of speech processing."

Lawyers acting for women who are suing UK clinics over health concerns linked to breast implants have launched a stinging attack on the medical regulator.

They accused the Medicines and Healthcare products Regulatory Agency (MHRA) of failing to take action to deal with complaints and for dismissing serious health problems linked to the devices.

More than 270 women in the UK intend to sue those clinics where they underwent surgery to be fitted with the implants, manufactured by French company Poly Implant Prostheses (PIP), which has now closed.

Lawyers say the number of complainants is growing rapidly and they have lodged class action cases.

The implants have been linked to the death of a French woman from a rare form of cancer called anaplastic large cell lymphoma, and are implicated in another seven or eight cancer cases. They are filled with an unapproved non-medical grade silicone believed to be made for mattresses and there have been reports that the protective barriers are faulty.

French authorities are expected to formally announce on Friday that up to 30,000 women who received the implants in France can have them taken out. But UK regulators have insisted there is no link with cancer and there is no need for women to have them removed.

Figures from the MHRA suggest 84,300 PIP implants have been sold in the UK since 2001. Based on the assumption that each woman has two implants, at least 42,000 women in the UK could be affected, according to the MHRA.

But the figure could be higher because women undergoing breast reconstructive surgery following cancer may only have had one implant.

Mark Harvey, a partner at Hugh James solicitors, which is representing more than 250 women, said some of his clients had complained of inflammation, fatigue and fibromyalgia, a musculoskeletal pain disorder.

In a statement, Mr Harvey added: "The recent reports have, of course, been very worrying to our clients, many of whom have already suffered terrible problems as a result of their implants. I have written again to the MHRA to urge them to react to the developments in France and, similarly to France, to set up a suitable protocol for women affected in this country."

A depressing picture - lack of alternative therapy rather than pHARMa influence ?

New figures I have obtained under freedom of information paint a troubling picture of the mental well-being of people in part of Wales and northern England.

It may be the recession, but I suspect the statistics showing very high levels of anti-depressant use in those regions have more complex origins.

The new numbers also show yet another increase in prescribing pills like Prozac, despite national guidance advocating alternative treatments - up 3.15% in Wales and 3.64% in England during 2008.

The previously unpublished data, given to me by the Prescription Pricing Authority in England and the Prescribing Services Unit in Wales, focus on January this year. If one looks at the number of prescriptions for anti-depressants issued in that month per thousand patients, a startling story emerges.

The top seven are all Welsh Local Health Boards (LHBs) in a small area in the south of the country. Of the top thirty prescribers, 12 are in Wales and 10 are Primary Care Trusts (PCTs) in the north-east of England.

We even see a local health authority prescribing at a rate greater than one prescription for 10 patients. In Torfaen, the area around Pontypool in south Wales, GPs handed out 104 prescriptions per 1,000 patients during January. This appears to be an astonishing level of anti-depressant use. GPs we have contacted blame a shortage of counselling for the high prescribing levels.

Both south Wales and the north-east of England are areas with high levels of people not in work, but deprivation cannot explain what one sees as the other end of the table. Of the 30 PCTs which have the lowest levels of anti-depressant prescribing, all but two are in Greater London. And these areas include some of the most deprived in England

The figures also show how January 2009 compares with January 2008, and I wondered whether this might reveal the effects of the recession. The map shows a less obvious regional picture.

The biggest year-on-year increases in prescribing are both in south Wales: Torfaen has seen a rise of over eight prescriptions per 1,000 patients in twelve months, consolidating its position at the top of the table.

Blaenau Gwent, Bridgend and Neath/Port Talbot have also seen very large rises. Six of the top 20 places ranked by the increase in prescribing anti-depressants are in Wales. Have free prescriptions made a difference? If so, why do figures for the Vale of Glamorgan and Wrexham show falls in anti-depressant use?

In England, Swindon and Sunderland, which have both recently seen big job losses and lay-offs as a result of the economic downturn, have seen anti-depressant prescriptions rise by more than five prescriptions per 1,000 patients.

Tameside and Glossop sees the largest increase in the past 12 months in England with at least one local doctor saying that the recession is having a serious effect on the area's mental health.

I have no doubt that the threat and impact of recession is having a psychological effect upon many people in the UK - but anti-depressant prescribing has been rising for years and, in fact, the rate of increase is falling. Comparing Jan 2007 with Jan 2008, the increase in England was 8.3%, and it was 9% in Wales.

A greater proportion of males with schizophrenia are first affected in adolescence, with 39 per cent of males and 23 per cent of females having their first psychotic episode by age 19.2 Treatment of schizophrenia remains difficult - over 40 per cent of sufferers stop taking their medication within the first year.3

Louise's story

"Growing up was very difficult for me," explained Louise, a 29-year-old Canadian who currently uses Abilify, and whose name has been changed to respect her privacy. "I was diagnosed with adolescent schizophrenia 14 years ago and my prognosis was bleak. I was told I would never work, finish school or have a normal life."

Louise was hospitalized 13 times for her condition, her shortest hospital visit lasting three weeks and the longest six months. She was put on an anti-psychotic drug resulting in her being "stable enough to be home, but not a productive member of society."

In 2008, she started treatment with Abilify through a special access program and began feeling better after only a few weeks. "Since my diagnosis, I had heard voices every minute, and then within two months the voices were gone. I've also lost 80 pounds since starting Abilify, and I don't sleep 15 hours a day anymore."

Louise's condition over the past three years has improved to the point that she is now working in a shop, selling and working with customers. "I love it," she said. "I've even gone back to school." She did not want to be identified because many people who know her now don't know about her disease and her past.

Louise is happy to have normal life and wishes the same for others living with schizophrenia. "What I want is for teenagers with schizophrenia to feel like there is hope and that they are not doomed to live ill."

The verdict came at the end of a weeklong first-degree murder trial for Infosino, whose attorneys tried to convince jurors he was suffering side effects from an improperly prescribed antidepressant drug when he awoke at 4 a.m. and attacked his longtime partner, Rita Chirel, inside the home they shared in suburban Delray Beach.

In closing arguments, Assistant State Attorney Andrew Slater played parts of the 911 call Infosino made hours after the October 2010 killing. In it, Infosino gruffly explained to the operator that he had killed Chirel and drank ammonia in an attempt to kill himself.

Infosino called his brother to express shame over what he had done and scrawled a letter Slater called "a perfect act of contrition," two signs Slater said meant that he knew what he was doing was wrong at the time of the attack.

Slater said Infosino, a former New York attorney who had recently lost a position of power in his homeowners association, simply failed to restrain his temper.

"This is a man whose life had fallen down around him. He's not the president, he's not the big cheese in the community that he used to be and he couldn't take it," Slater said. "It's no more complicated than that."

But Infosino's attorney Michael Schutt told jurors that the only thing that could explain Infosino's actions on the morning he killed Chirel was the culmination of disturbing side effects from the antidepressant, Remeron, also known as Mirtazapine.

Schutt described for jurors how the drug had transformed Infosino from a mildly depressed octogenarian into a paranoid, deeply disturbed man who suddenly thought the woman he described as "his life" was trying to poison him, steal his money and drive him crazy.

"Why would he beat to death the woman he loved, the woman he wanted to spend the rest of his life with?" Schutt asked jurors before adding of Infosino: "He had nothing to gain, and everything to lose with Rita dead."

Jurors began deliberating the case just after 2 p.m. and returned the verdict two hours later. Infosino faces up to life in prison when he is sentenced Dec. 21.

Schutt, who told jurors that Infosino could barely muster the energy to stay awake during his trial, said he disagreed with the panel's verdict. He and Assistant Public Defender Jennifer Marshall said though Infosino was mentally strong enough to understand that he had been convicted, his health is otherwise poor.

"His body's breaking down, he's got a terrible heart. He's dying," Schutt said.

Brianna is just 13 years old. A girl who was in the top sets at school, represented the school in athletics and has been a dancer since she was the age of 2, performing atLondon’s famous Sadler’s Wells Theatre and the Royal Albert Hall. In more recent years, she developed a love of drama and wants to be an actress when she is older. She is a popular girl, whom people always describe, as being very mature, fun loving and kind.

This was her life until Wednesday, October 19th 2011, exactly 3 weeks after having her first Cervarix vaccine jab at school on Wednesday 28 September. That day, she came home from school complaining of feeling very unwell, nausea being the main symptom. I kept her off school the next day, but on Friday being as it was the last day of term I sent her back. Later in the day, I received a phone call from the Matron saying she had a temperature and was feeling unwell, so could I collect her.

Initially I thought it was maybe connected to her period as she had this the same day. However, by the following Monday she was still feeling the same, nauseous, hot and cold and now also very faint. I called and spoke to our GP, who also thought the symptoms were connected to her period and prescribed some tablets to help with pain and nausea (she did not have any pain).

By now, it was half term week. Every day I attempted to go out with Brianna and her younger brother, but each time we were never out for long before she was begging to go home, as she felt so unwell. The tablets had no affect at all. Once home, she would lie on the sofa and just sleep.

I called the doctor again the following Monday, 31st October 2011. This time she told us to come in to see her. She requested a urine test and gave Brianna a thorough examination (she had a high temperature again) and prescribed Stemetil to help with the nausea – this does really help. All this time, Brianna had continued to feel nauseous, was experiencing hot and cold flushes, and feeling faint, dizzy, lethargic and generally unwell. It did not appear to be improving. We went back to the GP on Thursday when it was confirmed the urine tests were clear. The next step was a blood test, which would also include a check on glandular fever. This was done the next day. Brianna had to be absent from school all of that week.

She went back in to school on the following Monday and Tuesday, but came home quite pale and tired. She cried because the other children laughed at her when her face went red as a result of a hot flush. We returned to the GP on Wednesday for the blood test results which were all clear. By now, Brianna had also started to complain about aching arms and legs and a sore throat coming and going. The GP requested yet another blood test to check her thyroid. This has just been done and we are waiting for the result. She remained off school the rest of the week.

Then only just the other day, it was suggested to me that it could possibly be the HPV vaccine which was causing all these health issues. Something neither of us or the doctor had even considered. Once I started researching, I realised it could very well be the diagnosis as there were just too many similar health reactions being experienced by other girls who had become ill after HPV vaccinations.

Recently, my GP has spoke to GlaxoSmithKline, the vaccine manufacturer. They confirmed that with the exception of the flushes, all her symptoms are known side effects. My GP is now putting in an urgent referral to the Paediatrics at the hospital and will call me soon with the latest blood test results.

Brianna did return to school on Monday. She also went in on Tuesday but was feeling very weak and had a very painful sore throat. By midday the Matron called for me to go and collect her. She is still off school.

She should have received her second injection of Cervarix on the 16th of November 2011, but both her doctor and I agreed that it was not a good idea! Some days are better than others, but we have found the nausea is constant unless she takes her Stemetil. One other interesting thing is that Brianna has had regular annual eye tests and always had perfect vision. However, at her last test (3weeks ago), she was found to be short sighted. Is this another reaction???

Update: Brianna and I have now agreed on a part time schedule with the school, where she just attends the core subjects. However, we are finding that even doing just 2-3 hours at school on one day, makes Brianna feel so ill, and then she cannot attend school the next day – it’s a vicious circle. She is also now experiencing intermittent pain in her legs and arms, in particular, near the site of the injection. All her blood tests have come back clear and I have been advised that we have an appointment with the paediatrician on 13th December 2011.

Yesterday (2nd December 2011), I spoke to the matron about some hurtful comments other children were making when Brianna was in school e.g, “why aren’t you dead yet Brianna?” I am sure you can imagine how upsetting this was to both Brianna and me. The matron was disgusted and is going to speak to the pupils about how you should respect that people are unwell and not be nasty, in a forthcoming school assembly, without being specific about Brianna. As if my lovely daughter does not have enough to put up with without having to listen to these terrible comments that are being said about her

Again, that is Healy himself disclosing, admitting that in the majority of cases he testifies that SSRIs are not involved. In other words, the story Carl told about Healy, and the story Healy USED to tell about himself, are patently false.

You say i do not appreciate the significance of Healy and Olivieri; of course I do, especially Olivieri, who I lecture about to medical students. But they are clinical researchers; that is the point you have consistently refused to address. Pharma has a hold over them that is simply does not have over bioethicists. Which does not say that some biothicists are not influenced by Pharma. Of course they are. What it does say is the other point I have made over and over and that you have never responded to: the fact that "bioethicists" can be influenced by drug money does not mean that I am, any more than the fact that "patient advocates" can be influenced by drug money means that you are. And it is just ridiculous to say that, because a clinical researcher asked Art for a recommendation that he took, that Art therefore "does clinical trials." I mean, really. If the researchers decide not to use these implants on people because they read your CIRCARE column, are you then a clinical researcher?

The problem, Vera, is that you will just lump together any political issue that you think makes your ideological point; you simply obscure the differences between "bioethicists" and a particular bioethicist, or someone who gives advice to a clinical researcher and someone who does clinical research.

And if my insistence in using "scratched" to describe what hte monkey did (the word the researchers who were there used, by the way) is ideological, than your insistence on using the words "rip through his chest to yank the implant out" is equally ideological. I, at least, heard what happened from the people who were there, and use their description. You just make up the most emotionally volatile words you can think of as scare tactics.

And, finally, you misrepresent who is targeted by the researchers. There are many psychiatric patients who miss taking their meds for many reasons, not just because they "choose" not to take them. Patients come to doctors asking for ways to make sure they take their meds; that is why the two week injections that are offered now are very popular among patients.

A Winnipeg judge’s ruling that a teenage boy murdered his friend because of the effects of Prozac will not be appealed, confirming an apparent North American first and reviving debate around the widespread prescription of anti-depressants to young people.

Justice Robert Heinrichs concluded the 15-year-old boy was under the influence of the medication when he thrust a nine-inch kitchen knife into the chest of Seth Ottenbreit, a close friend.

Although the killer pleaded guilty to second-degree murder, the judge cited the drug’s alleged side effects as a reason not to raise the case to adult court, and to mete out a sentence last month of just 10 months – on top of two years already spent in jail.

A spokeswoman for the Manitoba Justice Department said this week prosecutors have decided not to appeal the provincial-court decisions, which were earlier met with outrage from Mr. Ottenbreit’s family and friends.

Both the boy’s lawyer and the psychiatrist who testified on his behalf say it is the first time a criminal-court judge in North America has made such a finding.

Prozac is meant to curb the effects of depression, but Justice Heinrich concluded it set off a steady deterioration in the young murderer’s behaviour.

“He had become irritable, restless, agitated, aggressive and unclear in his thinking,” the judge said. “It was while in that state he overreacted in an impulsive, explosive and violent way. Now that his body and mind are free and clear of any effects of Prozac, he is simply not the same youth in behaviour or character.”

Yet the empirical underpinning of his conclusion, and the pros and cons of young people taking Prozac and other “selective serotonin reuptake inhibitor (SSRI)” anti-depressants, seem less clear-cut.

Justice Heinrichs relied largely on the expert testimony of Dr. Peter Breggin, a controversial American physician known for his outspoken opposition to the use of virtually any psychiatric drug. Some other experts say scientific evidence of a link between the latest anti-depressants and homicide is thin.

“I think it got pulled out of a hat, frankly,” said Dr. Umesh Jain, a child and adolescent psychiatrist at Toronto’s Centre for Addiction and Mental health. “You could construct a weak and biologically plausible effect, but you’d have to be pretty convincing in court.”

Studies have established such drugs can increase the risk of young patients having suicidal thoughts. Their tendency to lift inhibition could also release some hostility or violence lurking in a person’s character, said Dr. Jain. Small studies like one he co-authored in 1992 have also suggested that the drugs can trigger short-term mania, especially in bi-polar disorder patients.

There is little or no scientific evidence directly linking the anti-depressants and serious violence or homicide, though, he said.

Still, the official “product monograph” approved by Health Canada for Prozac says the drugs are not recommended for use on adolescents, and warns that agitation, hostility and aggression might ensue. Doctors are allowed to prescribe medications “off label” to patients even when the approval does not expressly permit it.

Specialists in Winnipeg responded to concerns voiced by the accused’s parents by actually increasing the dose, said Greg Brodsky, the teenager’s lawyer.

“On Prozac he was becoming more irrational and aggressive,” Mr. Brodsky said. “That should have been a warning. That warning wasn’t heeded.”

SSRI drugs have a contentious track record. They were hailed originally as a safe alternative to older anti-depressants, then clinical-trial results came to light in 2004 that suggested they increased the risk of children and adolescents having suicidal thoughts.

Other studies have indicated they are effective in patients with major depression, but little better than a placebo for mild to moderate cases.

The Winnipeg murderer had a history of smoking marijuana, had abused prescription drugs and “experimented” with cocaine, but was trying to break free of that background when a family doctor prescribed Prozac for depression in July, 2009.

On Sept. 20, the accused met with Mr. Ottenbreit and another friend at his house, after the two friends had earlier stormed into his home, allegedly damaging the floor. The killer and Mr. Ottenbreit shared a cigarette, before the accused pulled aside a sweater on the floor of his garage, revealing the knife. He picked it up, “got this weird look on his face,” then abruptly stabbed his friend, the other boy told police.

“They were in my house, they dented the floor, I had nothing else to do but to stab him,” he told police later.

Dr. Keith Hildahl, clinical head of Winnipeg’s Child and Adolescent Mental Health program, testified that the Prozac might have played a role, but concluded on balance that his behaviour that summer was largely a result of the tense relationship he had with his parents.

Dr. Breggin, who has testified in a number of U.S. cases where anti-depressants allegedly led to murder or other violence and reviewed the Winnipeg case, pointed the finger of blame at the medication.

“These drugs produce a stimulant or activation continuum,” he said in an interview. “That continuum includes aggression, hostility, loss of impulse control … all of which are a prescription for violence.”

Dr. Breggin’s long-standing criticism of psychiatric drugs and opposition to the view that psychiatric problems have biochemical roots have prompted some supporters to call him the “conscience” of the speciality, and some psychiatrists and patient advocates to condemn him as a harmful influence.

Dr. Sydney Kennedy, psychiatrist-in-chief at Toronto’s University Health Network, said young people prescribed the drugs should certainly be closely monitored for side effects, but it would be wrong to shy away from using SSRIs on teenagers when necessary.

In fact, a 2007 study found that rates of actual, completed suicides jumped as use of the drugs on young people dropped amid the newfound concerns, suggesting they might have been saving lives before.

“In the large group data, SSRIs do a lot more good than harm,” Dr. Kennedy said.

A prominent British psychiatrist who found his offer of a post at a University of Toronto teaching hospital rescinded after he criticized a popular form of antidepressants says he stands by his controversial view of the drugs. Dr. David Healy said he continues to believe that Prozac and other drugs of its class — known as selective serotonin reuptake inhibitors — can be addictive and cause suicidal tendencies in some people.

“My views haven’t changed at all,” said Healy, who recently reached an out-of-court settlement with the university and the hospital, the Centre for Mental Health and Addiction.

“I think the SSRIs can make people suicidal. I think you can get physically dependent on them and can have a withdrawal problem. You may not be able to stop. Full stop.”

Healy, who teaches at the University of Wales, made the comments at a news conference Thursday, his first since he settled his $9.4-million lawsuit against the university and hospital.

The settlement, many of the terms of which remain undisclosed, has resulted in the university offering Healy a visiting professorship which will see him spend a week a year at the University of Toronto for several years, beginning next spring.

Healy launched the lawsuit after the university withdrew in November 2000 a five-year job offer to run the centre’s mood and anxiety program.

“I bore no ill will towards them,” he insisted Thursday. “And clearly the process going on too violently or too long wouldn’t do them any good, wouldn’t do me any good.”

That’s because Healy has other issues he wants to bring to the public’s attention, such as the way drug companies selectively release safety and efficacy data on drugs and use ghost writers to author articles on their drugs for submission to scientific journals.

“And there’s a real hazard that I go on about these things and the legal action was still there, people would say: “Well, we don’t need to pay any heed to that. He’s just saying this because he’s trying to sue the University of Toronto.”

“If I want people to listen to some of the other things, it seemed to be a good idea, (especially) when people on the other side (the university) were being reasonable and weren’t awful people.

A psychiatrist, who bore a striking resemblance to comedian Billy Connolly, came outside for a cigarette break, he couldn't help but look in the direction of the protesters as we were only about 5 yards away from him. He, like so many before him, had the usual smirk on his face, the patronising kind that suggests that he knows best. He looks toward our direction and says, "So, I hear you are Scientologists", then exhaled cigarette smoke in one of those laughing fashions. "Well, I'm not", I replied. His bottom lip quivered, he shuffled, shrugged his shoulders and eventually said, "Good for you." Hey great Mr Psychiatry man, if you are going to make a broad statement toward a crowd then, at the very least, have some form of defence if you are wrong. Then again, they do like to label people eh?

Controversial plans to axe some benefit payments to disabled people living in care homes are being dropped.

The government had planned to axe the "mobility" part of Disability Living Allowance - worth £51-a-week and currently paid to up to 80,000 people.

Disability charity Scope had condemned the move as "callous" and said it would leave people prisoners in their homes.

Work and Pensions Minister Maria Miller confirmed in a written statement to MPs that the plan will not now go ahead.

She said the decision had been taken "having listened to the concerns raised" and the proposal would be removed from the Welfare Reform Bill.

Up to 80,000 disabled people in care homes are thought to receive the mobility component of DLA - the government had argued that local authority contracts with care homes should cover residents' mobility needs.

Chancellor George Osborne announced plans to axe it in last year's spending review, aimed at saving £135m by 2014-15.

But it came in for heavy criticism from disability charities and campaigners - who said it was a lifeline for disabled people in residential care which helped them visit family, friends and attend things like doctors appointments and helped them live independent lives.

The government has since been reviewing the decision and two charities, Mencap and Leonard Cheshire Disability, asked Lord Low of Dalston to carry out a separate review.

The Low Review, which reported back earlier this month, found "no evidence of overlap" between the support provided by the government, and that provided by local authorities and said axing the benefit for those in care homes would "deny people control over their own lives".

'Integral'

Adam Penwarden of Turning Point, a health and social care provider, said he was "reassured" that the government appeared to have "listened to those who need support the most".

"This benefit is integral to the lives of some of the most vulnerable members of our society, allowing them to access and be part of their local community.

"The removal of this vital resource would have rendered many of them housebound, robbing them of the chance they would otherwise have to lead fulfilled and independent lives."

A Department for Work and Pensions spokesman said: "We have always been clear that we will not make any changes that stop disabled people in care homes from getting out and about.

"Our officials have spent the last few months gathering information and evidence, including visiting disabled people in care homes to find out from them and their families about their mobility needs.

"The Low Review also looked at some of the same issues and so we have been reflecting on the outcome of this work."

Richard Hawkes, chief executive of Scope, said the benefit was an "absolute lifeline" to disabled people: "News that the government is re-thinking its plans to scrap this payment will come as a huge relief," he said.

"However we are concerned that this relief could be short-lived. There are several other changes within the Welfare Reform Bill, currently being debated in the House of Lords, that could push thousands of disabled families, already struggling to make ends meet, over the edge."

The coalition plans to replace DLA, introduced in 1992 to help disabled people cope with the extra costs they face in their daily lives, with a new benefit called Personal Independence Payment (PIP).

All 3.2 million people receiving DLA at the moment, both those in work and out of work, will be reassessed.

Mr Hawkes said: "Critical flaws in the assessment and an extended qualifying period mean there is no guarantee that the payment will go to the people that need it the most."

Psychiatric watchdog Citizens Commission on Human Rights (CCHR) was joined by human rights supporters in Birmingham today, amid industrial action from public sector workers across Britain. According to CCHR, electroconvulsive therapy, also known as "electroshock treatment" or simply "electric shock," is a barbaric and inhumane way to treat mental illness and should be banned. Their protest was planned to coincide with the first national forum of the Electroconvulsive Therapy Accreditation Service (ECTAS), which was launched in 2003 to assure and improve the quality of the treatment's administration in Britain.

But CCHR said that ECTAS, which is an initiative of the Royal College of Psychiatrists' College Centre for Quality Improvement (CCQI), is a way to justify the continued use of ECT, which its placards likened to torture at today's protest. In addition to CCHR there are others calling for the treatment to be banned, including clinical psychologist Dr Lucy Johnstone, and a study by the Mental Health Foundation in London says that ECT appears to affect patients in much the same way as any brain injury.

"Shock damages the brain," they say, "causing memory loss and disorientation that creates an illusion that problems are gone, and euphoria, which is a frequently observed result of brain injury."

During the protest, a number of passers-by said they had experienced ECT themselves, using various negative adjectives to describe the treatment. A young man named Elliot offered to be interviewed on video by one of the protesters, about his own ECT story, while on the other hand, some members of the public could be heard asking, "What's ECT?" In response, protesters said that even patients themselves are not always told about the dangers of the treatment, preventing them from making an informed decision about receiving it, which they say adds to public distrust of the mental health profession.

1. Introductions and background

MHRA explained that the background to this meeting was a meeting held with Mr Fiddaman in September 2008. Mr Fiddaman had raised concerns about a lack of awareness on the part of health professionals of withdrawal reactions with SSRIs and related antidepressants. Prof Healy explained that he had had a long term involvement with the safety of SSRIs and that he received a large number of e-mails directly from people withdrawing from SSRIs asking for advice on management of withdrawal symptoms. Before the meeting Prof Healy had provided documents that he had produced relating to the management of withdrawal from SSRIs.

2. Existing advice on management of withdrawal reactions with SSRIs/SNRIs

All agreed that most health professionals get their information from guidelines issued by the National Institute for Health and Clinical Excellence (NICE) and the British National Formulary (BNF) rather than directly from the Summaries of Product Characteristics (SPC), although it was noted that the SPC was very important as it dictated the information that would be available to the patient through the Patient Information Leaflet. MHRA informed Prof Healy that they had provided input to the recent consultation for revision of the NICE depression guideline and that the revised guideline would be available towards the end of the year. MHRA had also informed the BNF that they were looking at the area of withdrawal reactions and would contact them in the future regarding proposals for updates to the relevant sections of the BNF. MHRA also raised the important role played by Prescribing Advisors in the Primary Care Trusts in influencing prescribing practice. Prof Healy said that a key point not included in the guidance currently available was the existence of liquid formulations of SSRIs which could be useful in the management of withdrawal to allow slow tapering. Prof Healy also stated that before treatment started there should be a discussion between the prescriber and the patient about the possibility of withdrawal reactions.

3. Awareness of withdrawal reactions in clinical community

Prof Healy expressed the view that general practitioners (GPs) were not aware that withdrawal reactions on stopping SSRIs could be prolonged in some patients and were not aware of how to manage withdrawal reactions in these patients. Prof Healy was concerned that GPs may instinctively advise patients to withdraw by taking tablets on alternate days and this was not an appropriate approach.

5. Dependence/withdrawal for women of child-bearing years

Prof Healy had asked for the issue of use of SSRIs in pregnancy to be included in the
agenda. He said that it was an important issue and the subject of upcoming court
cases in the USA. Prof Healy said that it was important that women of childbearing
years were appropriately informed of the risk of withdrawal reactions with SSRIs
before beginning treatment and stated that in his view doctors may be liable under
the Congenital Disabilities Act 1976 if they did not adequately inform patients of the
risks of treatment during pregnancy.

MHRA said there had been communications about a small risk of congenital
malformations associated with paroxetine and this issue was under further discussion
at EU level. Prof Healy highlighted a recent publication describing an animal study
looking at reproductive toxicity of a variety of SSRIs. MHRA asked for the reference
and to be kept informed of any further new evidence of relevance to this issue.

MHRA noted that NICE had published its antenatal and postnatal mental health:
clinical management and service guidance and that it was important that NICE was
kept informed of any new evidence or advice in this area. MHRA agreed to find out
whether review of the guideline was planned and to let Prof Healy know the best
contact point for communication on this issue. Post meeting note: Prof Healy
confirmed post-meeting that he had contacted NICE on this issue.

6. Opportunities for better communication with health professionals

Prof Healy said that the focus should be on highlighting to GPs that withdrawal
reactions could be serious and prolonged in some patients and agreed that NICE and
the BNF would be reasonable routes.

important to keep in contact on important new evidence in this area.

Health Trust 'failed in its duty of care' toward sexually abused child

The Southern Health and Social Care Trust "failed in its duty of care" towards an allegedly sexually abused child, the NI Ombudsman claims.

Ombudsman Tom Frawley said the service given by the trust "fell short" of expectations.

Figures released on Monday revealed that overall complaints were up 23% during the first half of 2011.

The health and social care sector was singled out as having more than doubled its number of complaints.

The ombudsman deals with complaints from people who claim to have suffered injustice because of maladministration by government departments, agencies and a wide range of other public bodies.

The latest figures show an increase in the number of complaints regarding health and social care from 75 to 117.

Mr Frawley said the case involving the alleged sexual abuse of a child was "all the more concerning given the nature of the allegation and the trust's statutory responsibility to safeguard children".

Statutory regulations breach

He said he had identified failings in adhering to required child protection procedures and in keeping sufficient records.

"I deemed this investigation so important that in addition to recommending a comprehensive apology and consolatory payment to the complainant (the child's mother), I recommended that the trust share the report with the Regulation and Quality Improvement Authority with regard to follow up action," he said.

The ombudsman also found that two separate GP practices were in breach of relevant statutory regulations after they struck patients from their practice list.

In both cases, the patients had received no warning they would be removed from the list or given any explanation of why they had not been told.

Mr Frawley also highlighted the case of an elderly woman suffering from dementia who was admitted to the Royal Victoria Hospital.

"The trust failed to utilise detailed nursing plans which would have led to more appropriate and importantly more effective communication with the patient and her relatives," he said

Carrick farmer sent for trial on assault charges

A Carrick on Suir farmer has been sent forward to trial at the Circuit Criminal Court on charges of assault causing harm and creating a substantial risk of death or serious harm.

John Hanrahan, Ballycurkeen, Carrick on Suir, appeared before the local District Court on Thursday when a book of evidence in the case was presented to him.

Hanrahan is charged that on May 22, 2007, he assaulted Eamonn Quirke, causing him harm. He is also charged with intentionally or recklessly driving a Volvo farm loader through a closed gate which created a substantial risk of death or serious harm to another.

State solicitor, Paul Fitzpatrick, said the Director of Public Prosecutions consented to send Hanrahan forward for trial.

Judge Terence Finn ordered the return of the charges to the next sitting of Clonmel Circuit Court, starting on July 1.

Bail was set in the defendant’s own bond of J3,000.

When the case was first called in the court, solicitor Eamonn Hayes, for Hanrahan, submitted a medical certificate on his client's behalf, saying he was unable to come to court.

However Judge Finn refused to accept this and issued a bench warrant for the arrest of Hanrahan, saying the defendant had no difficulty attending a crowded court room in the past.

Hanrahan came to court a short time later, when the short hearing proceeded

The one-man 'Human Race Get Off Your Knees' show has proved to be a tour de force after successful performances in Cleveland and Ohio.

In which he adressed the issue of nuisance, it is thought possible that 'noise' could be substituted for 'smell'.

"where the conduct relied on as constituting a nuisance is said to be an interference with the plaintiffs comfort in the enjoyment of his property, the test is whether the interference is beyond what an objectively reasonable person should have to put up with in the circumstances of the case. The plaintiff is not entitled to insist that his personal nicety of taste or fastidiousness of requirements should be treated as inviolable. The case for damages in nuisance -- we are not concerned here with the question of an injunction -- is made out if the interference is so pronounced and prolonged or repeated that a person of normal or average sensibilities should not be expected to put up with it. It is not necessary that an interference by objectionable smell should be so odious or damaging that it affects the plaintiffs' health. It is enough if it can be said that a reasonable person in the plaintiffs' circumstances should not be expected to tolerate the smell without requiring the defendants, to make financial amends. I consider that the plaintiffs have made out such a case."

The Hanrahans, who have farmed the 250 acres at Ballycurkeen for seven generations, had their case dismissed in the High Court in August 1985 by the present Chief Justice, Ronan Keane. They appealed it to the Supreme Court which held, in July 1988, that the family had in fact established Merck, Sharp & Dohme's liability to them for damages as a result of offensive smells emitted by the factory between 1978 and '83. The court also held that John Hanrahan was entitled to damages for his ill-health and the fatalities and deformities of cattle on the farm.

With an estimated £1 million in legal costs awarded to the Hanrahans, a date was fixed for the damages to be determined by the High Court but the amount was agreed in an undisclosed out-of-court settlement between the parties in November 1990. It was generally speculated at the time that the family had secured close to £2 million from the US-owned company but it has since emerged that it fell far short of the £1.8 million the plaintiffs had sought.
