WalesOnline - News - South Wales Valleys - Merthyr - Job losses at town’s leading law firm: "MORE gloom for leading law firm Hugh James as a formal consultation on job cuts has been announced.
Employees at the Merthyr Tydfil branch had already been left reeling after being told their departments were to be gradually moved to Cardiff, with some fearing their inability to move would force them to quit.
But the 18-year-old company, which employs 600 staff across Wales, has admitted the financial crisis has forced their hand and redundancies are being strongly considered."

With a predicted one in ten staff to be axed, according to managing partner Matthew Tossell, it leaves scores of workers left worrying for their jobs.

In a statement, the firm said: “Hugh James can confirm that its staff have been informed of the need to review staffing levels in response to the current economic climate and the difficulties being faced by a number of its clients.”

Mr Tossell sent a message to staff earlier this week claiming the impact on the recession meant that “like most UK businesses, Hugh James is having to take steps to cut costs in order to ensure the long-term future of the firm.”

Complaints made by Mrs Evans"

In 2001 Mrs Evans made multiple complaints to the Law Society against the solicitors (Hugh James in Merther Tydfil) who handled her compensation claim for respiratory disease in respect of her late father William John Thomas. The various documents attached to Mrs Evans' letter outline the complaints made. In particular Mrs Evans alleged that her solicitors had:



— delayed in "registering" Mrs Thomas' claim until May 1998;

— failed to make a timely application for an interim payment;

— failed to respond to individual letters and telephone calls;

— delayed in providing costs and client care information;

— provided advice and information that was confusing;

— failed to apply appropriate supervision to junior staff; and

— altered the claims form (claim questionnaire) without her knowledge or consent, in a way that artificially inflated the value of the claim.
Appeal to Law Society

Mrs Evans appealed the Law Society's original decision and this was reviewed by the Adjudication Panel and their ruling was handed down on 22 June 2005. The upshot being that Mrs Evans' appeal was upheld and two partners at Hugh James each received a severe personal reprimand from the Law Society in respect of their failure to properly supervise their staff. Additionally, it is clear from the Law Society's findings that the only reason a finding of misconduct had not been made is that (by reason of the poor supervision) it was not possible to identify the individual at Hugh James guilty of the misconduct. The Adjudication Panel raised Mrs Evans' compensation from £1,250-£5,000. Hugh James challenged the decision by way of Judicial Review.


Throughout the dispute Mrs Evans kept the Department (through its external lawyers Nabarro) appraised of her case and she also sent copies of the Law Society's report and findings to Sir Michael Turner, the Judge then overseeing the COPD scheme.


Department's consideration of the position

The Department carefully considered the issues raised, especially in terms of potential impact on the wider administration of the schemes. The main issue being the Law Society's finding that Hugh James Solicitors had altered Mrs Evans' claim questionnaire form. Furthermore, the nature of the supervisory failures by Hugh James Solicitors ("...monitoring individual files by computer screen and monitoring DTI statistics...") raised concern that these failures were not limited to Mrs Evans' case alone. It was also apparent that the two partners were two out of five members of the Co-ordinating Group (CG) of solicitors representing the claimants under the scheme.


A range of actions were undertaken:



— Nabarro (the Department's legal advisers) held a full meeting with Mrs Evans on 29 June 2004;

— a request was put to Capita's Security Investigation Department (SID) to filter out similar type cases intimated via Hugh James Solicitors for analysis;

— a letter dated 7 September 2005 was sent to the Senior Partner at Hugh James Solicitors requesting a full written explanation and detailing the organisational failures which have led to the findings against them, together with details of what changes have been made, in light of those findings; and

— a copy of the letter to Hugh James Solicitors was copied to a member of the Claimant's Group, suggesting that the CG should raise the issue at the next Review Hearing and address the issue in its written report to the Court.
Current position

As far as the Department is aware the case remains subject to ongoing review by the Solicitors Regulation Authority (SRA). In these circumstances the Department is not currently in a position to take further action

The leading law firms involved in handling the British Coal compensation claims pulled in £174.3m in the last year, despite the Solicitors Regulation Authority (SRA) continuing its investigations into several firms for misconduct.

Doncaster-based three-partner personal injury boutique Beresfords topped the breadwinners' list after bringing in £43.3m, according to figures derived from a written answer by Labour peer Lord Bach.

Thompsons Solicitors were second on £27.1m, followed by Cardiff-based Hugh James on £24m.

.One SRA insider said law firms reaping such huge sums of money on the back of miners suffering conditions such as respiratory disease and vibration white finger projected the wrong image of the legal profession.

"Some politicians are calling the saga a feeding frenzy for lawyers, and with figures like these coming out of the taxpayer's pocket it's hard to argue," said the source.

The SRA, however, said the 53 investigations into how the law firms have conducted themselves through the British Coal scheme will continue, despite many firms having to pay millions back to the Government after being overpaid.

Last year, as revealed in The Lawyer (9 April), 30 firms shared a pot of almost £800m for litigation costs.

Just weeks later, the High Court ruled that several miners law firms would have to repay the Government an estimated £100m after being overpaid in relation to the respiratory disease compensation scheme.

The Lawyer can now reveal that, according to the Government, the final figure that "several hundred firms" have to pay back is £80.6m. Beresfords was one of the firms indebted to the Government. According to the latest accounts the firm had to return £10.9m, which the Department for Business, Enterprise and Regulatory Reform (BERR) said had been paid.

In addition, there were 15 other firms that owed more than £100,000 to BERR - Avalon Solicitors among them. The Warrington-based firm's senior partner Andrew Nulty was last year ranked the second highest-earning lawyer in the UK, taking home £13m. He was only pipped to the post by Beresfords name partner Jim Beresford on £16.8m.

The BERR said around £6.3m remained outstanding by the time the debts were due to be settled on 30 May. "Agreements are already in place for repayment by some firms with outstanding debts by the end of the year," said a BERR spokesman, adding that after 12 June these payments would be subject to an 8 per cent debt judgement interest rate.

The spokesman added: "Discussions are also in hand with other firms where they have asked for some more time to settle their debt and the department is reviewing these requests on a case-by-case basis."

Beresfords declined to comment.

This Doncaster-based boutique last year could boast it had the UK's highest-paid lawyer, with senior partner Jim Beresford taking home £16.8m. But he may have lost this title.

According to the firm's latest accounts, Beresford's entitlement dropped by more than a third to £10.8m. His daughter Esta and Doug Smith, the other two partners in the firm, saw their average take-home fall from £1.8m to £1.3m.

The firm witnessed a revenue increase of 20 per cent on the previous year to £41m, but profit dropped from £20.4m to £13.5m. The accounts stated: "[This is] mainly due to the reduction of OROS [optional risk offer schemes] fees relating to the British Coal costs hearing which has recently been settled." In English that translates to profit is down because of the £10.9m Beresfords had to pay back to the Government after a High Court case

Avalon, ranked 7 in the table above, is contesting the Department's entitlement to recoup any money. As they are not members of the Claimant Group (CG), Avalon argues that the Court Order[25] is not binding on them. A Court Hearing to resolve this issue has been scheduled for w/c 26 November 2007. In the meantime the Department is beginning to recover the debt via a set-off arrangement of fees for claims due to the firm.

I am uneducated when it comes to other SSRi's. I cannot be expected to have knowledge of all SSRi's,

I have researched Seroxat and no other SSRi. If you or any other person want to ask about any other SSRi then create a blog like I did instead of creating a blog about someone you are obsessed with. Maybe then, you may get your questions about other SSRi's answered.

I have been granted a meeting with the MHRA. I will be discussing the Seroxat withdrawal issue because that is what I write about. If you want to discuss anything with them why don't you ask for a meeting?

It is not my job to discuss SSRi's that I know nothing about.

Service for 'forgotten paupers'
The hospital was opened in 1906 and closed five years ago
Thousands of former psychiatric patients could be buried in unmarked graves across Scotland, according to a Livingston MP.
Jim Devine called for an audit after it emerged that 831 patients of Bangour Village Hospital, West Lothian had been interred in cemeteries with no markers.
The MP said he would be writing to the health minister to request checks be made at other former hospital sites.
A service of dedication will be held at Ecclesmachan Church on Friday"



Catherine Ferguson, a local woman who discovered the graves after carrying out research, said: "It's important to have a memorial service for people who were forgotten in life and whose bodies were unclaimed in death."

Local historian Sybil Cavanagh said the hospital catered for people with mental health problems who were dependent on the state.


The local council has now placed plaques in the three cemeteries
"It was an asylum built in the early 1900s for Edinburgh's lunatic paupers, as they were then known.

"The Edinburgh Lunacy Board, which ran Bangour, also had responsibility for burying these patients in a very basic burial, with just the hospital chaplain and a hospital staff member there to see the patient into the grave.

"In most cases the board buried the patient because there was no-one to claim the body, the fact that they were unmarked would be purely a matter of finance as it was fairly costly to have a gravestone."

Mr Devine, a Labour MP, welcomed the commemoration of the former patients but said wider questions still needed to be answered.

"I'm writing to the health secretary, Nicola Sturgeon, asking her to find out how many former psychiatric patients are buried in unmarked graves in Scotland.

"If we've had nearly 1,000 people from Bangour alone, given that we've had 40 major psychiatric hospitals in Scotland, we could be talking about tens of thousands of people."

The bodies are buried at Ecclesmachan, Loaninghill and Uphall Old Cemetery. West Lothian Council have now placed plaques at the three locations.

It's a rainy day and you've just planted some petunias in the garden. Unknowingly you've created an earthly version of snail heaven. Snail hormones begin circulating and hearts beating.


Strangely, the hormone that activates the snail heart is serotonin, the psychotropic chemical so beloved by antidepressant manufacturers for its ability to quieten the human brain.
The snail heart copes well with the onslaught of serotonin. La Trobe pharmacologist Michelle Gibson has indentified two serotonin receptors in the snail heart and is investigating changes in intracellular chemicals.
These studies may have implications for humans as the snail heart could be used as a model to study, for example, the cardiovascular side effects of selective serotonin reuptake inhibitors, drugs like the antidepressant Prozac and some diet pills.
Dr Gibson says that snail heart tissue is much easier to obtain than human tissue and works as a good model. Snails hearts have a single auricle receiving blood from the lung and a single ventricle that pumps blood to the rest of the body, much like it does in humans.
Her results were presented to the Australian Health and Medical Research Congress in Brisbane."

I was elated when I got my own place, it meant I could see my children again, more importantly show them how their dad was getting better because I was tapering - and had been during my time spent living with my sister.

The zaps were still with me as was the irregular sleep patterns but I was happy in myself that I was 'getting there'."

I just did not care about anything, a complete lack of empathy for everyone and everything. I wanted the old me back, wanted my children to have a dad again. I couldn't see how that could happen. Here I was with a lump sum of money yet I was considerably withdrawn from reality. My world seemed my own and nobody else's. I didn't want anyone else to come into my world because I knew they wouldn't like it."

Paul Flynn - Read My Day: The young old: "The Seroxat case had a plea from the drug maker Glaxo Smith Kline. They 'invited' the claimants’ solicitors to discontinue the cases. Moreover, if they do so by 30th April 2009 then Glaxo say they will bear their own legal costs. If Glaxo were successful at trial in defeating the claimants then they could seek their own legal costs.
Not content with this, Glaxo are now, it seems, using brute force by writing to the Legal Services Commission and have asked them to withdraw public funding!"
